Separate creation of civil status from proof, later registration, relationship contracts, immigration, and celebration.
For a new marriage in Germany, register the intended marriage with the competent Standesamt, complete its legal review, then both declare personally before a registrar that you want to marry. A religious, symbolic, destination-style or private ceremony can be meaningful but does not replace the German civil act. Witnesses are optional under current civil procedure unless the chosen setting has a separate practical rule.
Germany has allowed marriage between two people of the same or different sex since 2017. It no longer creates new German registered life partnerships. A qualifying partnership created before 1 October 2017 can continue under legacy law or be converted. Conversion requires both partners to appear together and declare personally before the registrar; the partnership contract continues as a marriage contract and defined marital effects trace back to the partnership date (legacy partnership law).
Distinguish status from proof and consequences
A marriage validly celebrated abroad is generally recognised without one universal German recognition application when each person's substantive capacity rules and an accepted ceremony form were satisfied. A German authority can still examine validity when a benefit, name, tax, immigration, inheritance or new marriage depends on it. Optional Nachbeurkundung in a German marriage register can create convenient German certificates for eligible cases but does not rescue an invalid foreign ceremony (foreign marriage rules).
A foreign divorce is different: many decisions require formal recognition by a Land justice authority before Germany treats the former marriage as ended. EU instruments and the shared-home-nationality exception can change that route. Resolve it before booking a new wedding.
Name is a separate decision. Spouses may keep their existing surnames, choose one person's surname as Ehename, or, under the rules effective since 1 May 2025, form a two-part common name from both surnames, with or without a hyphen. International name law and existing multi-part names can change the options.
Property is also separate. German default Zugewinngemeinschaft does not pool all property. Each spouse remains owner of their property, while gains can be equalised when the regime ends. A different arrangement needs a valid marriage contract, normally notarised with both parties present.
Use German civil marriage when the ceremony will be here. Use foreign-marriage evidence or optional registration when already validly married abroad. Keep a legacy partnership only after checking cross-border, tax, parentage and administrative recognition consequences. Convert if marriage status is the intended legal result. Choose no surname change if separate names are preferred. Obtain an Eheurkunde for routine proof and a certified register extract when an authority needs the fuller entry and later annotations. Immigration, tax, parentage, inheritance and citizenship remain separate legal processes rather than automatic results of the ceremony.

The Standesamt tests whether both people can marry, not whether the relationship fits an immigration or financial plan.
German civil marriage requires adulthood. A person cannot enter a German marriage before turning 18, and a marriage with a person under 16 cannot be validly entered under the statutory rule (adulthood). Both must have legal capacity, understand the act, and consent freely. Prohibited close kinship and an existing marriage or registered partnership with a third person block the ceremony.
The ceremony declarations must be made personally and with both people present at the same time. They cannot be conditional or time-limited (personal declaration). A representative can sometimes register the intended marriage using written authority when one partner is prevented, but cannot give the marriage consent at the ceremony. If either person cannot sufficiently understand German, arrange the interpreter accepted by that Standesamt. The interpreter must be independent enough for informed consent and bring required identity and qualification proof.
Foreign status and prior relationships
For a foreign national, German conflict rules can require the Standesamt to test the person's national marriage law. The usual evidence can include an Ehefähigkeitszeugnis from the home-country authority. If the state does not issue an acceptable certificate or obtaining it is objectively impossible, the Standesamt prepares an exemption request for the president of the competent Oberlandesgericht. Do not apply directly or assume nationality alone guarantees exemption.
Every prior marriage or partnership must be conclusively ended by death, dissolution, annulment or conversion into the current relationship. A foreign divorce often needs German recognition under section 107 FamFG. The Land justice administration for a spouse's habitual residence is normally responsible; if neither lives in Germany, jurisdiction follows the planned new marriage or ultimately Berlin. A refusal can be reviewed by the Oberlandesgericht (foreign divorce recognition).
Residence decides registry jurisdiction, not the right to marry. Register at the Standesamt for either person's residence or habitual residence. If neither lives in Germany, use the Standesamt where the ceremony is intended. Once approved, the couple can generally marry at another German Standesamt after the file is transmitted.
German, EU, third-country, worker, student, family, self-employed and visitor status do not replace the civil-capacity test. A person without long-term German residence can marry if legal conditions and local jurisdiction are satisfied. Marriage does not itself grant entry, residence, work, insurance, tax benefit or citizenship. Family reunification depends on whether the sponsor is German, an EU free-movement beneficiary or a third-country title holder, plus relationship authenticity and route-specific conditions.
The registrar can ask questions where concrete facts suggest coercion, deception or a shared intention not to undertake marital obligations. A genuine couple should answer truthfully and consistently. Immigration benefit as one consequence does not itself invalidate a real marriage. Threats, inability to refuse, qualifying deception or a sham arrangement can support refusal or later annulment (annulment grounds). Never proceed to satisfy family pressure, an employer, an agent or a residence deadline.
Documents
Obtain Identity, Birth, Residence, Capacity, Divorce, Death, Translation, Apostille, and Name Evidence
Order only the exact versions and issue dates specified by the responsible Standesamt.
Start with valid passports or accepted identity documents for both people. The Standesamt then maps civil status through public records: current birth-register extract or foreign birth certificate, residence or Melderegister evidence, nationality proof where the passport is insufficient, and documents for every relevant prior marriage or partnership. German register data may be retrieved internally in some municipalities, but do not assume automatic access across offices.
A previous relationship file commonly needs the marriage or partnership certificate, final divorce or dissolution judgment with proof of finality, death certificate, or conversion record. If the divorce occurred abroad, add the German recognition decision unless an EU instrument or statutory exception clearly applies. A decree without proof that it became final is often incomplete.
Cross-border evidence must prove authenticity and meaning
A foreign national may need a current Ehefähigkeitszeugnis or the documents required for an Oberlandesgericht exemption. These can include civil-status, residence, nationality, prior-relationship and home-law evidence. The exact state, issuing authority and document format matter. Do not substitute an embassy letter, single-status affidavit or online extract unless the Standesamt accepts it.
Foreign public documents can require an apostille or legalisation and a complete German translation by an accepted sworn translator. Covered EU public documents, including birth, marriage, divorce, name, nationality and residence records, must generally be accepted as authentic without apostille; a multilingual standard form can reduce translation needs. That EU rule does not decide the document's legal effect (EU public documents).
Validity windows are document and office specific. German register extracts and residence certificates are often requested in recent form; Berlin's current foreign-participation service, for example, requires specified German register extracts to be no older than six months on registration. Hamburg lists a residence certificate for some foreign applicants no older than four weeks. Treat those as local examples, not a national rule. Ask the office to write the required issue date for every item.
For name choices, bring current birth and family-name evidence, prior name-change records, naturalisation records, and foreign-law evidence if a choice-of-law declaration is considered. State spelling, diacritics, order, hyphen and every previous name consistently. An Ehename can be declared during the ceremony or later; a later declaration generally needs the prescribed authentication.
Never mail irreplaceable originals without confirming the receiving address, return method and tracking. Provide originals or certified copies where required, plus office-approved translations. Keep colour scans, certification pages, apostilles, envelopes, payment proof and a numbered index. If a record cannot be obtained, document authority searches, refusals, destruction, conflict, displacement or country conditions and ask which substitute proof the registrar or court will accept.
Final check: identical names and birth details across passport and civil records; every citizenship disclosed; address and marital status current; each divorce final and recognised if required; translation covers stamps and annotations; apostille attaches to the correct original; interpreter independent; and intended surname legal under the applicable law. Correct the source register or passport discrepancy before buying duplicate translations.

Contact the Standesamt for either person's registered or habitual residence. If neither lives in Germany, contact the intended ceremony office. Send a factual profile, not documents to an unverified address, and request the checklist, accepted translators, foreign-document verification rules, appointment channel, fee schedule and earliest feasible ceremony range.

Resolve blocking dependencies. Obtain German recognition of a foreign divorce where required. Request fresh civil records, apostilles or legalisation and translations in the office's order. If a foreign Ehefähigkeitszeugnis is required, obtain it. If it cannot be accepted or issued, give the Standesamt the exemption documents so it can prepare the Oberlandesgericht request.

Decide names and obtain advice on property, inheritance, parentage, residence and tax where the consequences are material. A German marriage contract must be recorded by a notary with both people present (notarial form). Do not delay the registry file for an optional celebration contract, but sign any necessary agreement before the event it is meant to govern.
Register and complete the ceremony

Attend the registration appointment with originals, translations, identity, any interpreter and payment. Both normally attend. Where one cannot, ask whether a written Vollmacht is accepted for registration. Where both cannot attend, written registration can exist in the statutory framework, but the office controls form and authentication. Obtain a receipt, case reference, list of retained originals and written notice of missing items.

Respond to document or interview requests. The Standesamt examines capacity and can require more evidence where public records are insufficient. When no impediment is found, it issues notice that the marriage may proceed. That approval binds the performing office for six months unless relevant facts change (procedure law). Report a new marriage, separation from a prior status, citizenship, name, residence or other capacity change immediately.

Book the legal ceremony only within that window. You may generally choose another German Standesamt after the approval file is transferred. Confirm special venue, accessibility, interpreter, guest, security, witness, music and identification rules separately. Both people must appear and say yes personally. A proxy wedding is not available.

Check the ceremony record before signing: names before and after, birth details, date, place, chosen name law and interpreter. Order sufficient Eheurkunden. Use the international certificate only where accepted; use the certified Eheregister extract when fuller data or annotations are needed. Keep the original securely and issue copies selectively.

After a name change, replace affected German identity cards and passports, residence documents, driving licence records and professional IDs. Update employer, payroll, tax office if required, health and other insurers, pension, bank, landlord, utilities, university, vehicle, benefits, wills, powers of attorney, emergency contacts and foreign authorities. Domestic qualifying employee spouses are generally placed into IV/IV automatically; alternative tax withholding requires a separate request. A foreign marriage may need active evidence.

For family residence, file the correct German, EU or third-country sponsor route with the marriage proof. Do not wait for a surname document if the immigration deadline can be met using the valid certificate and an explanation. Save each submission receipt and final updated record.
Costs and Timing

Local fees can be modest, while foreign documents, verification, interpretation, travel, and special venues dominate the real budget.
Ask for a written municipal calculation because Land fee law and local options differ. The legal budget can include registration and capacity review, foreign-law supplement, Ehefähigkeitszeugnis or exemption processing, foreign-divorce recognition, document verification through an overseas mission, affidavit, name declaration, file transfer, another-office ceremony, out-of-hours slot, external venue, certificates and search for an unknown register.
Berlin illustrates the structure, not a national tariff. As checked on 25 August 2026, its foreign-participation service lists EUR 45 for registration and capacity review, EUR 45 per person whose foreign law must be considered, income-related higher-court exemption cost, EUR 30 for an affidavit, EUR 40 for a ceremony at another office, EUR 80 outside opening hours, EUR 75 to EUR 150 outside official rooms, EUR 12 for a standard or international certificate and EUR 6 for an additional same-type copy ordered together (Berlin fees).
Hamburg currently charges at least EUR 74.50 for marriage registration, with more for documents, names, another office, Saturday or outside venue. It states that the ceremony itself has no additional fee when held at the same residence Standesamt that handled registration; special place and time options cost extra (basic ceremony). Other Länder and municipalities differ.
Include the real cross-border cost
Price each birth, marriage, divorce, death, residence and capacity record at the issuing authority. Add certified copies, apostille or legalisation, courier, international bank fee, embassy appointment, German sworn translation, document verification, interpreter, travel and accommodation. A document that expires before filing can force a full repeat. Order after the Standesamt confirms the exact version.
A divorce-recognition or capacity-exemption fee may depend on income, Land law or complexity. A notary calculates a marriage-contract fee from statutory value rules and the agreement; each party may also want independent legal advice. Immigration, new identity and residence documents, tax advice and foreign registration are separate budgets.
A basic civil ceremony needs no commercial planner, photographer, rings, witnesses, reception, special venue or paid date. Keep optional celebration spending contractually separate from legal approval. Use refundable or postponable venue, travel and supplier terms until foreign law and documents are cleared. Wedding insurance exclusions should be read before purchase.
Processing has no safe nationwide duration. A simple domestic file can move within local appointment capacity; foreign divorce recognition, capacity exemption, authenticity checks and missing records can take months. The successful Standesamt approval remains usable for six months, so do not obtain it too early relative to the ceremony. Ceremony calendars may open before legal registration, but a reservation is not approval.
Avoid brokers selling guaranteed appointments, capacity exemptions, sham partners, unverified foreign certificates, translation without the required status, or access to a supposedly secret registry list. Official forms and preliminary guidance are available from the authorities. Pay only to named public bodies, verified translators, notaries and contracted suppliers, retaining the fee notice and receipt.
Validity and Next Actions

The marriage does not expire, but approval, source documents, identity papers, immigration permission, and later declarations run on different clocks.
The Standesamt's positive capacity review is valid for six months from its notice. The ceremony must occur within that exact window; otherwise registration and examination are repeated. A relevant change before the ceremony must be reported and can alter or cancel approval. Retain the notice and transfer confirmation if another office performs the marriage.
Source documents have their own freshness rules. If a ceremony is postponed, ask which birth, residence, capacity or civil-status records must be reissued and whether existing translations and apostilles remain usable. Never assume the six-month approval automatically extends the underlying foreign certificate.
Prove and operationalise the marriage
The Eheurkunde has no ordinary renewal date. Order replacements from the Standesamt holding the marriage register, normally the ceremony office. Standard, international and certified-register forms serve different recipients. Later name changes or divorce are added as annotations, and a new certificate can reflect them (certificate route).
If the surname changes, an old-name German identity card becomes invalid. Apply without delay unless a valid passport or temporary passport already shows the new name; review children's documents where their names changed too (identity update). Coordinate passport and travel bookings so names match. Foreign nationals must follow their nationality's passport-name process and then update the German residence document.
For payroll, qualifying spouses married domestically are generally assigned tax classes IV/IV from the first day of the marriage month. An application for III/V or IV with factor takes effect under current rules and must generally reach the tax authority by 30 November for the current year (tax update). Withholding choice does not itself determine final annual tax. Recheck current law and filing duties.
Marriage does not renew a visa or residence title. File the appropriate family route before the existing title or lawful stay expires, using the valid certificate, sponsor status, housing, means, insurance, language and other route-specific proof. EU free-movement family, German-family and third-country sponsor rules differ. Keep the immigration submission receipt.
A move before the ceremony can change the easiest registry contact but does not automatically invalidate an already accepted file. Notify both the reviewing and ceremony offices. A move abroad after marriage can change tax, property, succession, name and divorce law. Register the marriage abroad only where that country requires or usefully permits it.
Backward plan: obtain the bespoke list before non-refundable spending; resolve foreign divorce and capacity issues several months ahead; order fresh records in the office's stated window; register no earlier than six months before the legal ceremony; confirm file transfer and interpreter well before the date; order certificates at the ceremony; replace name documents and file residence promptly afterward.
On job change or graduation, update family insurance and payroll separately. On separation, record the separation date, housing, children, finances, immigration and tax effects and obtain advice. A marriage ends only through death, final divorce or another legally effective dissolution, not by moving out, deregistering or leaving Germany.
Problems and Remedies
Fix Missing or Stale Records, Unrecognised Divorce, Name Conflicts, Delay, Refusal, Coercion, Sham Offers, and Certificate Errors
Identify whether the blockage comes from evidence, foreign legal effect, registry judgment, safety, fraud, or a separate immigration process.
For a missing record, return to the issuing registry or archive and request the exact full, certified version. If it was destroyed or no authority issues it, collect official non-availability statements, archive searches, alternative registers, school or religious records, witnesses and identity history. Give the Standesamt a chronology and ask which substitute proof or affidavit route it accepts. Never buy a fabricated single-status or birth certificate.
For a stale document, confirm whether only the underlying record must be reissued or whether the translation, apostille and verification must also be repeated. A changed page or new annotation can make an old translation incomplete. For a spelling mismatch, correct the source record or passport where possible; do not ask the translator to harmonise names silently.
Separate foreign effect, registry refusal, and safety
An unrecognised foreign divorce is not cured by a new marriage application. Identify whether an EU recognition rule, the home-state exception or Land procedure applies, obtain proof of finality and service, and file with the competent justice administration. Address refusal through the stated Oberlandesgericht route. Use a family lawyer for disputed notice, public-policy, religious, non-judicial or multiple-nationality cases.
If the Standesamt delays, confirm the file reference, complete-document date, outstanding authority response, approval expiry implications and next review date in writing. Escalate administration concerns to the office leadership or supervisory authority. If the office refuses an official act, section 49 PStG lets an interested person ask the competent court to direct the Standesamt; the office can also submit a doubtful case itself (court direction). Obtain the written refusal and legal-remedy information before filing.
A religious ceremony alone does not create German civil status. If it occurred abroad, test the law of the ceremony place and each person's capacity rather than labelling it automatically valid or invalid. Do not claim single status while that question is unresolved.
For coercion, threats, document seizure, confinement, planned removal abroad or violence, contact police or emergency services when immediate, and a specialist forced-marriage, domestic-violence, youth or victim service confidentially. Do not use a family-controlled phone, email, interpreter or address. A registrar must receive each person's free personal consent. Safety planning can be more urgent than confronting family or cancelling publicly.
A broker offering a marriage partner, guaranteed residence, proxy ceremony, false divorce, paid appointment or hidden payment is a serious warning. Preserve messages and payment records, stop sending documents or money, secure accounts, contact the bank and seek police and immigration-law advice. A genuine marriage can still face immigration scrutiny; answer with truthful relationship and life evidence rather than rehearsed stories.
For an incorrect Eheurkunde, compare it with passports, the signed ceremony record and source documents. Request correction from the register-holding Standesamt, supplying authoritative proof. A wrong downstream tax, insurance or residence record must then be corrected separately.
Qualified advice is proportionate for contested foreign divorce, missing civil status, conflicting national laws, child marriage history, coercion, sham allegations, major assets or business, international marriage contract, parentage, inheritance, residence refusal, or court proceedings. Ask about Beratungshilfe or Verfahrenskostenhilfe where finances qualify, while preserving every main-case deadline.
