A Freiberufler performs a qualifying liberal-professional activity under tax law, commonly a specifically listed scientific, artistic, literary, teaching, healing, legal, tax, technical, or similar profession with the required personal qualification and independent work. The Finanzamt ultimately classifies the income. A liberal professional normally does not register a Gewerbe or pay trade tax, but still completes tax registration, VAT analysis, bookkeeping, insurance, and professional requirements.

Separate the main operating routes

A Gewerbe covers most independent commercial, retail, production, platform, agency, brokerage, hospitality, craft, and other business activity. A sole trader is the simplest legal form, but still registers the trade locally, receives tax registration, can owe chamber contributions and trade tax, and has unlimited personal liability. A side business follows the same classification rules even when employment, study, pension, or family duties are primary.

Qualifying self-employed artists and publicists can enter Künstlersozialversicherung. KSK determines eligibility and coordinates statutory pension, health, and care contributions so the insured person generally bears a share comparable to an employee. It is not a business registration and does not cover unemployment or business liability (KSK overview). Clients can separately owe Künstlersozialabgabe without deducting it from the artist's fee.

A regulated profession or protected title can require qualification recognition, chamber membership, authorisation, language, reliability, health, premises, or professional insurance before services begin. The Recognition Finder identifies the occupation and authority (professional recognition). Crafts can require Handwerksrolle registration; health, legal, architecture, engineering, teaching, security, transport, food, and financial activities have distinct rules.

Platform or one-client work must be tested for genuine independence. Personal instructions, integration into the client's organisation, fixed hours and place, client equipment, no substitution, no pricing freedom, and no entrepreneurial risk indicate employment. A contract label, business registration, or invoice does not cure Scheinselbstständigkeit.

A GbR, partnership, UG, GmbH, cooperative, or other company may fit multiple founders, investment, liability, governance, or tax needs, but creates formation, capital, accounting, publication, payroll, and director-status duties. It does not automatically convert the working founder into a socially independent person.

Choose no-action only where the activity is genuinely unpaid private activity or employment. Otherwise, classify before trading, use a sole route where proportionate, and obtain tax, chamber, professional, or status guidance before adding a company merely for appearance.

German and EU, EEA, or Swiss citizens generally do not need a residence permit solely to become self-employed, but professional, tax, trade, and insurance duties remain. Third-country nationals must read the exact Erwerbstätigkeit wording and additional sheet. Permission for employment is not necessarily permission for self-employment, and a tolerated or pending status can have different restrictions.

Test immigration and professional access separately

For a commercial Section 21 route, the authority normally examines economic interest or regional need, positive economic effect, and secured financing. A liberal-professional route requires viable funding and any necessary professional licence. Applicants over 45 normally need adequate old-age provision. The initial permit can run up to three years and extension depends on successful activity and ability to support the applicant and family (self-employment residence). Graduates, researchers, family members, existing skilled workers, and artists can have specific routes or discretionary conditions; obtain written confirmation before invoicing.

Next classify the profession. A foreign qualification in a regulated profession needs formal recognition and additional authorisation conditions before protected practice. A non-regulated occupation can often be performed without recognition, but tax classification as Freiberufler is a separate question. Trade, craft, food, transport, security, weapons, childcare, finance, health, and premises rules can require local or Land approvals.

Genuine independence depends on the total actual relationship. Test who chooses method, hours and place; who bears errors, downtime, investment and market risk; whether substitution and other clients are realistic; whose systems and email are used; who sets price; and whether the person is integrated like staff. One client is not automatic employment, but it raises risk and can separately trigger statutory pension insurance for a self-employed person without covered employees. The free DRV status procedure can decide in advance and officially averages about three months (status determination).

An employed person must check contract, conflict, competition, confidentiality, working-time, rest, performance, and notification or consent rules. Public servants can need approval. A student's self-employment changes health insurance and residence analysis based on time and economic importance, not merely revenue. Family insurance has income limits. Benefit recipients must report activity and forecasts before starting.

Finally test viability: realistic clients, price excluding VAT where applicable, working capital, sickness reserve, insurance, tax advances, late payment, permits, language, and family costs. The immigration authority, Finanzamt, professional body, health fund, pension insurer, KSK, and employer each decide only their part.

Keep one consistent evidence pack for authorities while protecting client and personal data.

Start with passport or ID, address registration, residence title and supplementary sheet, tax ID, bank details, civil status, and current health cover. Add a precise activity description, target clients, delivery method, work locations and countries, qualifications, licences, professional recognition, references, pricing, revenue and profit forecast, financing, and business plan. Immigration files may also need client letters, contracts, capital or loan proof, housing, family needs, and old-age provision.

Match records to each authority

For a liberal profession, keep the Finanzamt correspondence accepting or questioning the income classification, ELSTER tax questionnaire, tax number, and professional body evidence. For a trade, keep Gewerbeanmeldung, municipal receipt, any permit, chamber and accident-insurer correspondence, tax registration, and where applicable Handwerksrolle extract. A registration receipt is not a professional licence or residence permission.

The ELSTER questionnaire records start date, legal form, management address, activity, expected turnover and profit, income-tax advance basis, VAT route, bookkeeping, bank, and related entities. Save the transmitted copy and protocol, not only a screenshot. In the official ELSTER forms directory, select the tax-registration questionnaire for sole proprietors; it covers both commercial and freelance activities.

Insurance files need statutory or private health and care decisions, pension-status assessment, voluntary unemployment evidence where applicable, KSK application and decision, accident-insurer status, and business liability or professional indemnity policy. Keep annual income estimates and later tax assessments used for contribution reconciliation.

For genuine independence, preserve signed client contracts, statements of work, change orders, proposals, price negotiation, multiple-client marketing, working-time autonomy, own equipment, substitution rights, deliverable acceptance, invoices, late-payment notices, business expenses, and actual communications. The operational evidence must not contradict the written contract. Share client personal data only where legally necessary and redact unrelated commercial information.

Invoices need sequential identity, supplier and customer details, tax number or VAT ID as applicable, issue date, unique invoice number, quantity and type of supply or service, performance date, net amount, tax rate and tax amount, or the correct exemption statement, plus payment terms. Cross-border, reverse-charge, small-business, travel, construction, and platform cases need specific analysis.

Original electronic invoices and records must remain accessible and unaltered. Retention varies by category, commonly ten years for specified books, eight for accounting vouchers, and six for other listed records, subject to extensions (record retention). Before filing, reconcile name, address, activity, start, legal form, permit, classification, VAT treatment, invoice text, bank, and insurance across every record.

Setup Steps

Complete each dependency in the order that prevents unlicensed work, missed tax, and uninsured exposure.

Do not begin with a logo, company, or paid package. Begin with the actual service, legal status, permission, and cost model. A wrong early classification can create back taxes, contributions, permit breaches, and invalid invoices.

Follow the registration order

  1. Describe and classify the activity. Separate each service or product, client type, location, control, qualification, and revenue stream. Ask the Finanzamt or tax adviser about Freiberufler status, the Gewerbeamt or chamber about trade duties, and DRV about worker status where facts are ambiguous.
  2. Secure immigration and professional permission. Obtain the self-employment or freelance residence permission where required, plus recognition, chamber, craft, health, premises, security, transport, food, or other licence before the protected activity begins. Preserve the valid-from date.
  3. Register the operating route. A Gewerbe normally registers with the municipality before commercial trading and pays the local fee. The office transmits data to other bodies, but confirm each follow-on registration. A pure Freiberufler skips Gewerbeanmeldung and starts with the Finanzamt.
  4. Complete tax registration. Create ELSTER access early and electronically submit the Fragebogen zur steuerlichen Erfassung, generally within one month after starting. State credible turnover and profit, bank, VAT, and bookkeeping choices. Save the transmission protocol and tax-number Bescheid.
  5. Choose VAT deliberately. Test taxable, exempt, reverse-charge, intra-EU, and small-business treatment. From 2025, the domestic Kleinunternehmer thresholds are EUR 25,000 prior-year and EUR 100,000 current-year net turnover; crossing the current-year limit ends exemption immediately (small-business VAT).
  6. Arrange insurance and finance. Confirm health and care, statutory pension category, KSK, accident route, voluntary unemployment option, professional liability, business liability, equipment, cyber, interruption, disability, and legal protection as relevant. Open bookkeeping and a separate business account even where not legally mandatory.
  7. Set up invoices and records. Use correct VAT wording, numbers, performance dates, and payment terms. Every domestic business must be able to receive structured e-invoices; an email inbox can suffice, while issue transition rules run through 2026 and for qualifying smaller issuers through 2027 (e-invoice FAQ).

After the first invoice, record revenue and expense, reserve VAT and income tax, verify client acceptance, chase late payment, update the cash forecast, and check whether actual work still matches permit, tax, and social status.

Costs and Timing

Price services from total annual business and household cost rather than desired take-home income.

The ELSTER questionnaire and official tax number are free. A Gewerbeanmeldung has a municipality-specific fee, and regulated permissions, recognition, certified translations, criminal-register evidence, chambers, craft register, notary, commercial register, or company formation add activity-specific costs. Check the official local tariff instead of using a national average.

Build the full monthly reserve

Income tax applies to taxable profit after allowable business expenses and personal tax rules, with advance payments set by the Finanzamt and reconciled in the annual return. Church tax and solidarity surcharge can apply. A commercial sole trader or partnership can owe trade tax. The statutory individual and partnership allowance is EUR 24,500 of trade income; the 3.5-percent assessment amount is multiplied by the municipality's Hebesatz, and income-tax credit rules can offset part (trade-tax law). Freiberufler income is not trade income if correctly classified.

Standard VAT is usually collected from the client, offset by deductible input VAT, and remitted on the filing schedule. It is never spendable revenue. A Kleinunternehmer does not charge German VAT under the exemption and normally loses input-tax deduction. High startup investment, business clients, foreign sales, or expected threshold growth can make ordinary VAT preferable. Waiving the exemption binds the business under detailed rules.

Health and care cover are compulsory and self-employed people generally bear the entire contribution or private premium. Statutory voluntary contributions use minimum and maximum assessment, actual income reconciliation, fund supplement, care rate, and sickness-benefit choice. Some craftspeople, teachers, carers, midwives, artists, publicists, and one-client self-employed people owe pension contributions. KSK can share qualifying artist and publicist contributions.

Add professional or business liability, accident cover, disability or sickness reserve, unemployment protection, pension saving, accountant and payroll, software, bank and card fees, e-invoicing, legal advice, data protection, licences, chamber dues, coworking or rent, deposit, utilities, phone, equipment, depreciation, maintenance, vehicle, travel, marketing, training, bad debt, and foreign-exchange cost.

Calculate billable days after weekends, leave, sickness, administration, sales, training, and gaps. Add client payment terms and VAT before comparing a fee with employee gross salary. Keep separate reserves for VAT, income and trade-tax advances, annual insurance reconciliation, refunds, and at least several months of household expense.

Avoid paid registration forwarding, tax-number sales, unnecessary company packages, fake business addresses, and insurance sold without exclusions. Public startup advice can be free, but tax and legal advice is worthwhile for mixed activities, foreign clients, staff, property, licences, or status risk.

Ongoing Deadlines

Treat every new client, service, country, employee, and residence change as a status review.

A trade should be registered before commercial activity begins under the local rule. Both commercial and freelance founders generally transmit the electronic tax questionnaire within one month after starting. ELSTER access itself can take time, so create it before the planned launch and retain the transmission protocol. A pending tax number does not excuse wrong VAT or missing records.

Run a compliance calendar

Enter income-tax and trade-tax advance dates from the Bescheid, VAT advance and annual return dates from the assigned route, annual income and trade returns, EÜR or accounts, KSK and insurer income estimates, chamber reports, payroll if staff are hired, licence renewals, and residence-title expiry. Filing frequency and annual statutory dates change, and professional extensions differ from unrepresented deadlines; use current ELSTER and authority notices.

Reconcile monthly bank, cash, receivables, invoices, VAT, expenses, travel, assets, and private withdrawals. Lock original electronic invoices and preserve audit-readable formats. Accounting vouchers generally have an eight-year retention category, specified books ten, and listed correspondence six, but tax proceedings and special assets can extend retention. Never delete solely because a software subscription ends.

Monitor the Kleinunternehmer thresholds in real time. Once current-year net turnover exceeds EUR 100,000, exemption ends immediately for the threshold-crossing transaction. Prepare VAT pricing and invoices before approaching the limit. Every domestic business must continue to receive e-invoices; issue obligations expand after the 2026 and 2027 transitions.

Report material income changes to the statutory health fund, KSK, pension insurer, benefit office, and immigration authority under their rules. An unexpectedly high tax assessment can produce retroactive health contributions; keep the final tax notice and update forecasts rather than waiting for reconciliation.

Start residence renewal several months before expiry. Show continuing authorisation, revenue, profit, clients, tax compliance, health cover, financing, family livelihood, and business development. A filed renewal may protect lawful stay under immigration rules, but do not assume it expands the permitted activity or cures an earlier breach. Preserve the application certificate and seek immigration advice.

A new service, shop, employee, partner, company, regulated task, foreign client, foreign workday, home move, business address, bank, name, or closure can trigger updates. Employee reporting begins before payroll and accident-insurer duties apply. Cross-border work requires tax, VAT, permanent-establishment, and social-security analysis.

On closure, deregister the trade where applicable, notify the Finanzamt, submit final VAT and tax filings, settle staff and insurance, collect receivables, preserve records, and keep an address for decisions. Do not close the bank or portal access until refunds, audits, and liabilities are resolved.

Problems and Remedies

Correct False Self-Employment, Wrong Classification, VAT Errors, Mixed Expenses, Late Tax, and Insurance Gaps

Stop the ongoing error, reconstruct the facts, notify the correct body, and preserve formal appeal rights.

If a client controls work like an employer, preserve the contract and actual instructions, schedules, access, equipment, organisation chart, prices, substitution, other clients, leave, performance management, and payments. Do not create retrospective invoices or false independence evidence. Either party can request the binding DRV status procedure. A finding of employment can create contribution, payroll tax, leave, wage, dismissal, and residence consequences, while separate one-client pension duty can exist even where self-employment is genuine.

Correct the right classification

If the Finanzamt treats an activity as Gewerbe rather than Freiberufler, request the written basis and separate each activity, qualification, personal professional work, staff role, and revenue. Mixed inseparable work can contaminate classification in some legal forms. Register the trade and address trade tax, chamber, and invoices where required, while preserving objection rights. A Gewerbeamt registration does not force the Finanzamt to accept or reject liberal-professional tax status.

For missing VAT, first determine whether the supply was taxable, exempt, small-business, reverse-charge, export, or intra-EU. Stop issuing the wrong template, calculate transaction dates and amounts, correct invoices lawfully, amend advance and annual returns, pay the tax and interest reserve, and notify clients where input deduction changes. Never simply add VAT to a closed consumer price without checking the contract.

For mixed private and business expenses, reconstruct the business purpose, date, amount, invoice recipient, payment, allocation method, vehicle or home-office use, and VAT. Remove unsupported private costs and correct returns. Keep original evidence and a transparent calculation. Cash withdrawals are not expenses.

If tax is late or unaffordable, file accurate returns even when payment cannot be made, contact the Finanzamt about the account, update advances, and request lawful deferral or instalments with evidence. Ignoring estimates, enforcement, or portal notices increases the problem. An Einspruch normally has a one-month deadline shown in the tax Bescheid; payment is not automatically suspended, so request Aussetzung der Vollziehung where justified.

For health or pension arrears, contact the insurer immediately with activity start, income, tax notices, prior cover, family status, KSK, and client facts. Seek a written calculation and instalment route. A permit, trade registration, or private travel policy does not replace German compulsory health cover.

Use Finanzamt and chamber startup guidance, health funds, DRV, KSK, recognition counselling, immigration advice, and unions where status is disputed. A tax adviser is proportionate for VAT, foreign business, staff, mixed classification, or audits; a lawyer for residence, professional prohibition, major status liability, insolvency, or court deadlines. Bring one chronology, registrations, decisions, contracts, accounts, and the exact correction sought.
