Match the stage, subject and task to a service instead of searching for one universal free lawyer.
Use a triage ladder. First, the authority, employer, university, landlord, trader, bank, insurer or provider can explain its own file and accept a complaint, but it does not give independent advice against itself. Second, a subject specialist can orient and sometimes represent you. Germany's justice service maps employment disputes to unions or employee associations, benefit disputes to social advice, bills and purchases to consumer centres, debt to recognised debt advice, family support to the Jugendamt or family counselling, housing to tenant organisations, and violence or crime to victim services (low-cost services). Membership, scope, waiting periods and fees vary.
Choose by task and stage
Migration Counselling for Adult Immigrants, youth migration services and asylum-procedure counselling help locate competent services, understand letters and organise next steps. They are not automatically substitutes for a lawyer in litigation. Ombudsmen and conciliation bodies can address consumer, energy, telecom, banking, insurance and lawyer-client disputes. Participation and binding effect depend on the scheme.
Check legal-expenses insurance, union, tenant association, professional association, employer benefit or credit-card cover before state aid. Notify the provider immediately, request a written Deckungszusage for the exact dispute and ask about deductible, excluded fields, waiting period, choice of lawyer, appeal, mediation and enforcement. Do not assume a policy bought after the dispute covers it.
Beratungshilfe funds qualifying lawyer advice and, where needed, out-of-court representation for a person with low income and assets. It does not fund an already pending court case. Prozesskostenhilfe funds qualifying civil and other court litigation; in family and voluntary-jurisdiction matters the equivalent is often called Verfahrenskostenhilfe. The court tests affordability, prospects and whether a sensible self-payer would proceed (official overview).
A Rechtsantragstelle can record permitted applications and statements and explain procedure, but it is neutral and does not become your lawyer. Some courts permit self-representation; higher courts and particular proceedings require authorised representation. Criminal defence follows separate rules, including Pflichtverteidigung based on the nature of the case rather than ordinary low-income court aid.
Recommended route: workers first check union or legal insurance; tenants check membership and urgent housing help; consumers use the trader and relevant conciliation route; migrants combine specialist counselling with an immigration lawyer where individual representation is needed; families use youth or family services but preserve court deadlines; businesses normally budget professional advice because consumer and low-income individual routes may not fit. A well-documented, low-value issue can lawfully end after free clarification if cost, prospects and personal importance do not justify escalation.
Eligibility
Test Financial Need, Available Alternatives, Merits, Residence, Case Stage, Court, and Representation Rules
Nationality is rarely the deciding factor; finances, alternatives, task, stage and competent court are central.
For Beratungshilfe, the Amtsgericht assesses low income and usable assets, whether another reasonable help route exists, whether the request is non-abusive, and whether this is an out-of-court matter. Insurance, a union, tenant association, youth office, debt service or other suitable free route can displace state funding. Showing that the service refused, was unavailable in time, lacked the required power or did not cover the issue can matter.
German nationality is not a general condition. Residence identifies the usual court: the application normally goes to the Amtsgericht for the applicant's German place of residence. Without a general German domicile, jurisdiction can follow where the need for advice arises (Germany legal-aid route). A passport, EU identity card, residence title or Duldung can establish identity. Immigration status, employment, student, family or self-employed status matters mainly because it changes evidence, available specialist services and the underlying law, not because one label guarantees aid.
Separate advice aid from court aid
Beratungshilfe can cover advice and necessary out-of-court correspondence. If a court proceeding in the same matter is already pending, use the court-aid route. In criminal and administrative-offence matters, advice-aid representation is restricted, and criminal trial defence uses criminal-procedure rules. Tax advisers and specified regulated professionals can provide advice aid within their authorised fields.
For Prozesskostenhilfe, the deciding court checks whether you cannot pay, can pay only partly or in instalments, the proposed claim or defence has sufficient prospect of success, and it is not mutwillig. It also checks other funding such as insurance or association cover (court-aid conditions). The merits test is preliminary, not a promise that you will win.
There is no safe nationwide gross-income cutoff. The calculation uses income, taxes and social contributions, reasonable housing, dependants, employment allowance, special burdens and usable assets. A spouse or partner's finances can affect support and household calculations without automatically making every asset available. Self-employed applicants must document business results and private withdrawals, not just one low month.
Court jurisdiction depends on subject and stage: civil, labour, social, administrative, finance and family procedures differ. Apply to the court where the case is or will be heard, not to a social-welfare office. Court aid is proceeding and instance specific; appeal, enforcement, interim relief, counterclaim or a separate dispute may need another request.
Before committing, ask the insurer or association in writing, use the official advice-aid pre-check, and ask the competent court registry which form and court receive the request. For cross-border EU civil or commercial litigation, use the e-Justice forms and receiving or transmitting authority. The foreign court's national eligibility rules still control.
Documents
Build a Complete Financial File, Case Chronology, Deadline Sheet, Cover Decisions, and Court-Ready Evidence Pack
Prove both why you need funding and why the underlying legal step is coherent.
Create two indexed sections. The financial section needs identity, address, household and dependant details; wage slips or benefit decisions; pension, maintenance, rent, freelance and foreign income; statements for every bank, savings, payment and investment account; cash, securities, vehicle, property and other assets; rent and utilities; insurance, debt, garnishment and disability-related costs; and support received or paid. For Beratungshilfe, current official guidance requests statements for all accounts covering the previous three months. A current Sozialhilfe decision can be sufficient in the stated branch, while other benefit recipients may need additional evidence (advice-aid documents).
Self-employed applicants should add recent accounts, tax assessments, business bank statements, liabilities, private withdrawals and an explanation of exceptional months. If a document is unavailable, file on time with substitute proof, identify the issuer and date requested, and state when the original evidence will follow. The court may demand more records; silence risks refusal.
Prove the legal problem and the route
Build a one-page chronology with date, event, actor, document and consequence. Attach the contract, order, lease, employment record, administrative decision, court paper, notice envelope, invoices, payment proof, messages, photographs and witness list that establish the claim or defence. Mark the date and method of service, every deadline, requested remedy and value. Include your own complaint, objection or settlement attempt and the response.
Add the legal-expenses policy and written coverage decision, union or association membership and refusal, and evidence that a free specialist service was unavailable or insufficient. State whether another application for aid covers the same matter. For court aid, add the proposed claim, defence or appeal with facts, legal goal and evidence, plus the official personal-and-economic-circumstances form. The online assistant produces the form but does not itself submit the legal proceeding.
Use copies unless the court or professional specifically requests an original. Do not surrender your only decision, envelope, passport, residence card, contract or receipt. Label each attachment and keep an identical submission set. Redact irrelevant third-party data only after checking that the full item, account holder, balance and transaction evidence remain verifiable. A court can need unredacted financial proof.
Foreign records may require a German translation; apostille or legalisation concerns authenticity and is not automatically required for every private document. Ask the receiving court before paying. For EU cross-border applications, use the required official language and transmission route.
Final consistency check: same legal name and address, explained aliases, identical dates and amounts, all accounts disclosed, household members reconciled, underlying party correctly named, Aktenzeichen on every filing, and deadlines confirmed from the original notice. Save the sent PDF, attachment list, postal proof, court-stamped copy or Mein Justizpostfach receipt.
How to Apply

Run the funding request and deadline-preserving legal action as coordinated but distinct workstreams.

Triage immediate risk. Call emergency services for present danger and use violence, victim, child-protection or crisis services where applicable. For imminent eviction, dismissal, detention, benefit loss, deportation, child removal, asset freeze or expiring appeal, ask the competent court or qualified lawyer about interim relief now. Funding paperwork alone is not an emergency order.

Record the underlying deadline and responsible body. Preserve an objection, claim, defence or appeal using a legally accepted channel even if the aid decision is pending. Obtain procedural advice before filing an incomplete claim that creates costs. An e-Justice legal-aid form expressly warns that the aid application does not affect litigation or appeal time limits.

Ask the suitable free specialist and existing funder. Send the insurer, union or association a concise chronology, relief sought and deadline. Retain the coverage or refusal decision. Use the competent authority's complaint process where it can correct the matter without litigation.
File advice aid or court aid

For Beratungshilfe, use the official pre-check and prepare the application. Submit it orally at the responsible Amtsgericht, by post, in person, through Mein Justizpostfach where supported, or through a participating law office. The court visit is often simplest and a complete oral application can be decided immediately (application channels). In Hamburg and Bremen, book the public legal-advice service instead.

Find a lawyer in the correct field. State the opposing party for a conflict check, the deadline, language needs and that you have or are applying for Beratungshilfe. The certificate concerns a defined matter, not unlimited future work. Agree what the lawyer will do, whether representation letters are included, who holds originals, and what happens if aid is refused.

For Prozesskostenhilfe, prepare the financial declaration plus the proposed proceeding. A lawyer can file both, often with the claim or defence. Where representation is not mandatory, you can apply yourself; the court's Rechtsantragstelle can record permissible applications but cannot advise strategy. The court that will hear or is hearing the case decides (court-aid application).

Separate channels. The online assistants generate forms and personalised checklists; they do not necessarily transmit them. Post needs trackable delivery to the correct address. Personal filing needs a stamped copy. Mein Justizpostfach needs the final sent-message and attachment receipt. Ordinary email may not be valid for a formal court submission.

After filing, record court, date, method, Aktenzeichen, attachments and pending deadline. Answer court questions completely by their deadline. Confirm that the lawyer has accepted the mandate and which legal step has actually been filed. After approval, read whether aid is full, partial, by instalments, limited to an instance, and whether a lawyer was assigned. Notify relevant insurer or association to prevent duplicate payment and keep every cost decision for later review.
Costs and Cover
Calculate the EUR 15 Advice Contribution, Public-Service Fees, Private Charges, Court Exposure, Instalments, and Hidden Costs
State aid reduces defined costs but does not turn litigation, translation, travel, enforcement, or an adverse judgment into a free service.
Beratungshilfe through a lawyer or other authorised advice professional has a statutory EUR 15 contribution. The professional may waive it, and no further expenses are charged under that fee item. The state normally pays the remaining eligible advice-aid remuneration. Ask for a receipt. If aid is refused after advice, withdrawn, or the statutory recovery branch applies after you obtain value, private cost can arise under the disclosed conditions (official application notes). Agree in writing what happens before work starts.
Hamburg and Bremen replace standard Beratungshilfe with public services. As checked on 25 August 2026, Hamburg ÖRA normally charges EUR 15 for the matter including follow-up advice, reducible to EUR 5 for very low income; Bremen and Bremerhaven normally charge EUR 10 per consultation (public advice). Recheck appointment, eligibility and fee locally.
Itemise every remaining cost
Free authority information, migration orientation, discrimination first advice, ombudsmen and debt counselling can reduce cost, but scope varies. Consumer centres may charge by topic. Tenant associations, unions, social associations and legal insurance usually require contributions or premiums and can have waiting periods, excluded pre-existing disputes, deductibles and limited fields. Obtain the current written price and cover decision instead of relying on a nationwide average.
A private lawyer can charge statutory RVG fees, an hourly or other valid fee agreement, and disbursements. Ask before instruction for the estimated range by stage, VAT, court and expert costs, travel, translation, interpreter, certification, copying, enforcement and appeal. A private fee agreement can exceed what an opponent or state fund later reimburses.
Prozesskostenhilfe can cover court fees, bailiff, court expert and witness costs and eligible own-lawyer fees. It does not pay the underlying debt, damages, fine or interest. If you lose a civil case, it normally does not pay the opponent's lawyer, even when your own costs were funded (covered and excluded costs). In a first-instance labour judgment case, each party normally bears its own lawyer, so the opponent-lawyer branch differs, but appeal rules and other costs must still be checked.
The court can approve aid with no instalment, partial payment or monthly instalments based on disposable income. Payments last no more than four years or until covered costs are met and can change with finances (instalment rules). Losing can still produce a large opponent-cost order; winning can still expose you if the opponent cannot reimburse your outlay.
Budget translation and interpretation separately. Courts may arrange an interpreter where law requires it, but not every meeting or document translation is funded. Cross-border cases can require translated forms and evidence. Travel, childcare, lost work time, postage and secure copies are practical costs. Avoid paid form sites, guaranteed-win brokers, upfront pressure, unverifiable lawyers and duplicate memberships. Verify lawyers through the official bar register and pay only against an engagement and traceable invoice.
Deadlines and Changes

Aid status changes over time, while the underlying legal clock can keep running.
If you see a lawyer before obtaining a Beratungshilfe certificate, the retrospective application must reach the Amtsgericht within four weeks after the advice activity begins. Confirm that the law office will apply, obtain a copy, and calendar the court-receipt deadline yourself. A certificate granted first avoids that risk. If a court asks for missing financial or case proof, its response date is separate.
No general rule makes a funding request stop the underlying objection, limitation, dismissal, immigration, benefit, appeal, defence or hearing deadline. Preserve the legal step by the correct method or obtain urgent professional advice. A postmark, courier scan, online draft or email acknowledgement is not always proof of timely court receipt. Keep a court stamp, qualified electronic receipt, fax transmission record where still accepted, or other procedure-specific proof.
Manage approval and later review
Processkostenhilfe can be requested before or during a proceeding, but applying late can leave earlier costs uncovered. Approval relates to the described case, court instance, party and scope. Appeal, enforcement, interim relief, counterclaim, settlement beyond the case, or a new dispute may need a fresh request or express extension. Ask before incurring cost.
Read an approval for instalment start, payment reference and review duties. Pay the Landeskasse, not an unverified collector. If income falls, rent or dependant costs rise, ask promptly for recalculation with proof. If income or assets improve, report as required rather than waiting for the annual check.
For four years after the proceeding ends, the court can reassess finances. A sustained gross monthly change of more than EUR 100 and every address change must be reported. A material asset gain can also matter. Current justice guidance notes that available wealth substantially above EUR 10,000, including inheritance or litigation recovery, can trigger a lump-sum order (financial review). Keep the court decision, end date, Aktenzeichen, payments, financial forms and change notices through that period.
Moving within Germany does not transfer the old court file automatically. Notify the approving court directly with old and new address and Aktenzeichen, and separately update the lawyer and underlying authority. A job start, job loss, graduation, separation, new child, disability, benefit change or self-employment can alter disposable income and available union or insurance cover. Report facts, not assumptions about their effect.
For an EU cross-border civil or commercial case, identify where the court will sit and use the legal-aid application and transmission authority for that state. Germany's July 2026 e-Justice listing names competent transmitting and receiving authorities and accepts German for the relevant German application route. The European Small Claims Procedure can handle eligible cross-border claims up to EUR 5,000 excluding interest and expenses, but its litigation deadlines and legal-aid request remain separate.
Backward plan from the earliest legal date: two weeks to identify the field and lawyer where possible, one week to collect complete finance and case proof, same-day filing for urgent matters, and confirmation immediately after submission. The next milestone is always the filed legal step, aid decision, lawyer acceptance, payment schedule, later review date or fresh application for the next instance.
Problems and Help
Handle Missing Proof, Delay, Refusal, Lawyer Conflict, Wrong Advice, Language Barriers, Scams, and Urgent Court Protection
Correct the funding problem without abandoning the underlying claim or defence.
For missing proof, submit what exists, list every missing item, provide substitute evidence and show when you requested the original. Correct inconsistent names, accounts, household members, income periods, rent or case dates in a signed note. Never hide an account, transfer, foreign income or asset. False or grossly incomplete information can cause refusal, withdrawal, repayment and potential criminal consequences.
For silence, confirm court receipt and Aktenzeichen before assuming delay. Ask whether evidence or a form is outstanding and state the earliest underlying deadline. Do not repeatedly restart identical applications. If a lawyer has the file, ask in writing which aid and main-case documents were filed, when, by which channel and with what receipt.
Challenge the correct decision
A Beratungshilfe refusal or withdrawal is challenged by Erinnerung. The statutory application notes describe it as not subject to a fixed period, but act immediately and address each reason with proof (advice-aid remedy). A refusal because an alternative exists needs evidence that it is unavailable or inadequate; a financial refusal needs corrected figures; a same-matter refusal needs a precise scope distinction.
A qualifying Prozesskostenhilfe refusal can be challenged by sofortige Beschwerde. Civil Procedure Code section 127 sets a one-month mandatory period and statutory limits tied to the main case's value and refusal ground (court-aid complaint). Follow the decision's Rechtsbehelfsbelehrung and the procedure governing that court. Preserve the main claim or appeal separately.
If the wrong specialist was chosen, request the complete file and an itemised invoice, then obtain a second opinion without missing the deadline. A conflict check can require a different lawyer. If language prevents informed instruction, ask for a lawyer or service in the needed language and clarify interpreter and translation cost in writing. Never sign a settlement, withdrawal, confession, fee agreement or power of attorney you do not understand.
For poor lawyer communication, send a dated request stating the question, deadline and required confirmation. Escalate service and bill disputes to the law office, then the regional Rechtsanwaltskammer for professional issues or the independent Schlichtungsstelle der Rechtsanwaltschaft for eligible fee and damages disputes (lawyer conciliation). These routes do not decide or pause the underlying case. Negligence compensation can require separate advice and proof of instruction, breach, causation and loss.
Treat guaranteed approval, guaranteed victory, requests to pay a court or lawyer through crypto or gift cards, remote-access demands, and paid copies of free official forms as warning signs. Verify court contact from the official justice directory and a lawyer through the official register. Preserve messages, bank details, invoices and screenshots; contact the bank and police after suspected fraud.
For immediate danger, criminal detention, domestic violence, child safety, eviction enforcement, deportation, critical benefit loss or an expiring court deadline, contact the competent emergency, victim, court or specialist lawyer route now. Ask specifically about einstweiliger Rechtsschutz, injunction, suspension, appointed defence or another emergency measure. Qualified help is proportionate whenever representation is mandatory, liberty or housing is at risk, the law is cross-border or specialised, the claim is high value, evidence is contested, or one missed date could end the remedy.
