Turn a consumer problem into a clear claim in Germany

Choose the legal route that matches the transaction rather than asking generally for a refund.

A shop purchase has no universal statutory change-of-mind return right. The shop can offer a voluntary policy and set its conditions, but defective goods remain covered by Gewährleistung. A distance or off-premises consumer contract generally adds a 14-day Widerrufsrecht, subject to timing, information and exceptions. Keep those routes separate.

Match the problem to the remedy

For non-conforming goods, complain to the seller. The initial statutory route is normally repair or replacement, with the consumer's choice subject to the legal limits. The seller bears the necessary transport, labour and material costs. Reduction or rescission can follow refusal, failure, unreasonable delay or serious circumstances. For purchase contracts concluded from 31 July 2026, choosing a repair during the ordinary two-year warranty period can extend that period once by twelve months (current warranty and repair rights). Record the contract and repair dates. A manufacturer guarantee or paid guarantee insurance is optional and additional; use it only if its written terms improve on the free statutory route.

For an eligible online, telephone, mail-order or doorstep contract, withdrawal ends the contract without needing a defect or reason. State Widerruf clearly and on time. Customised and perishable goods, opened sealed hygiene items, dated accommodation, transport, leisure and catering, fully performed services, and immediately supplied digital content can be excluded or lose the right under exact conditions.

Digital content, apps, cloud and connected goods must match contractual and objective requirements, remain usable and receive required updates. Remedy begins with restoring conformity, then price reduction or termination where legal conditions are met. Protection can apply when personal data rather than money is the counter-performance.

Subscriptions and continuing services require notice under the contract and law. Covered web-sold continuing contracts need an accessible cancellation button, saveable timestamp and immediate electronic confirmation. Extraordinary termination for serious breach is separate.

Package travel differs from a flight or hotel booked alone. The organiser of a covered package is responsible for included services and must have insolvency protection; transfer, price change, cancellation and defect notification have travel-specific rules.

Energy and telecom have direct complaint and specialist conciliation. Banks and insurers have internal complaint, ombudsman, BaFin supervision and court routes. BaFin cannot award an individual refund.

Use no further action for a minor preference issue outside withdrawal and voluntary policy. Use withdrawal for eligible change of mind, Gewährleistung for defect, cancellation for a continuing contract, and the sector route for regulated services. Preserve court and limitation deadlines during any informal process.

Protection follows the purpose and parties of the transaction, not citizenship or the language of the website.

A consumer is a natural person acting mainly outside commercial or independent professional activity; the counterparty must be acting as a trader for many mandatory protections. Citizenship, visa, student or employee status does not change that test. A self-employed person can still be a consumer when buying mainly privately, but a business name, VAT invoice, intended professional use and communications can point the other way.

Private sellers are not bound by the full consumer regime and can often limit defect liability, subject to fraud, express promises and other mandatory rules. A marketplace is not automatically the seller. Identify whether it sold the item, only hosted a third-party shop, processed payment or handled fulfilment. The invoice, imprint, order and terms should identify the contractual trader.

Test channel, product, timing and country

Withdrawal generally needs a distance or off-premises consumer contract. A normal in-store purchase does not qualify merely because the buyer later contacted the shop online. Click-and-collect can depend on whether the binding contract formed online or only at collection. Financial services, credit, travel and other products have special withdrawal rules.

For goods, Germany normally has a two-year statutory defect limitation from delivery, with special branches and possible shortening for qualifying used goods only through proper agreement. If non-conformity appears within one year, it is generally presumed to have existed at delivery unless incompatible with the goods or defect (burden of proof). After that, the consumer may need technical or factual proof. Continuous digital elements have their own presumption.

The defect must concern agreed characteristics, advertised or objectively expected quality, quantity, compatibility, installation, instructions, durability, security or updates, not damage caused by misuse or ordinary wear. A known specifically disclosed defect can be excluded only under strict conditions.

A commercial warranty can last longer or offer direct manufacturer service, but cannot reduce statutory rights against the seller. Read coverage, territory, registration, exclusions, proof, shipping and remedy before choosing it.

EU consumer rules support purchases from EU traders and may apply where a non-EU trader targets Germany, yet enforcing outside the EU can be difficult (EU guarantee FAQ). Trader location, applicable law, jurisdiction, payment route and assets matter. The European Consumer Centre can help with eligible cross-border EU, Icelandic or Norwegian traders.

Before spending on experts or court, ask the trader to confirm its legal identity and position, check the exact contract and remedy date, and obtain consumer-centre or legal advice where consumer status, cross-border reach, used goods, serious damage or limitation is disputed.

Create a dated file that proves the contract, promise, performance, problem, notice, remedy and loss.

Save the complete order page, product description, price, delivery promise, trader identity, imprint, terms, withdrawal instructions, warranty, subscription period and cancellation terms as dated PDF or screenshots with URL. Keep the order confirmation, invoice, payment statement, financing agreement, marketplace messages and any advertisement that influenced the decision. A cropped image without seller or date is weaker.

Document delivery using tracking, carrier scan, pickup record, package condition, unboxing photos and witness where proportionate. For non-delivery, preserve the promised date and seller-carrier communications. Unless the consumer independently chose a carrier, the professional seller normally remains responsible until receipt.

Record the defect and remedy history

Photograph and video the item, serial number, packaging, labels, error messages, setup, accessories and damage in good light. Keep original files and metadata. Write a chronology covering first use, ordinary handling, update, failure, safety concern, troubleshooting and every repair attempt. Do not dismantle, overwrite or keep using an unsafe product unless a competent expert advises it.

For services or digital products, preserve contract, account tier, uptime, exported logs, screen recordings, promised functionality, device and version, required updates, support tickets, lost access, created content and data-export requests. Redact other users and passwords.

Send the complaint in text form to the legal seller. Identify contract and defect, state the chosen remedy, give a reasonable dated deadline where required, offer safe inspection or return, and request a written response. Save the sent message, delivery receipt, ticket and reply. A phone call can help but should be summarised immediately in writing.

For withdrawal, keep the declaration and proof of timely dispatch, then photograph returned goods and package, list contents, use tracked shipping and retain receipt. Do not send merely to an address found on a parcel label without checking the trader's instructions. Never surrender the only original receipt; send a copy.

A chargeback or payment dispute file needs transaction, merchant identity, promised performance, direct complaint, response or silence, cancellation or return proof, and scheme reason. The bank sets contractual card-scheme deadlines that can be shorter than civil limitation. A chargeback is not guaranteed and does not erase a legitimate debt automatically.

For an expert report, define the technical question and cost responsibility before commissioning. Reconcile names, dates, model, serial, amount, remedy and addresses across the entire file, and prepare a one-page chronology plus indexed attachments for mediation or court.

First Action

Give the responsible trader a precise, provable opportunity to resolve the exact legal problem.

  1. Identify the contract. Name the legal seller or service provider, order, date, item, amount, channel, payment and consumer purpose. Do not direct a statutory seller claim only to the manufacturer or marketplace.
  2. Classify the problem. Choose change of mind under covered withdrawal, non-conformity, non-delivery, service breach, subscription cancellation, unfair charge, package travel, utility, telecom, finance or suspected fraud.
  3. Stop further harm. Disconnect unsafe goods, secure accounts, freeze a compromised card, cancel credentials and preserve evidence. Do not destroy or return the only evidence before recording it.
  4. Choose the initial remedy. For a defect, request repair or replacement. The seller may refuse the chosen route if impossible or disproportionately costly. For non-delivery, set an additional deadline unless the date was essential or the trader clearly refuses. For an eligible distance purchase, declare Widerruf unequivocally without giving a reason.
  5. Send a complete written notice. Include facts, legal route, remedy, reasonable calendar deadline, inspection or return offer, attachments and requested response. Use the contract complaint channel plus a provable durable copy. Keep sensitive ID and payment data minimal.
  6. Handle withdrawal performance. A covered consumer withdrawal is generally declared within 14 days; timely dispatch of the declaration is sufficient. Return performance runs on its own 14-day framework. The trader refunds standard delivery and can wait for goods or dispatch proof; the consumer can bear direct return shipping where properly informed (withdrawal consequences).
  7. Preserve the item and mitigate loss. Store it safely, follow reasonable seller instructions, photograph packing, and obtain approval before expensive self-repair. Do not continue accumulating avoidable loss.
  8. Send one deadline reminder. Quote the first notice, delivery proof and expired date. State the next proportionate route: price reduction, rescission, sector complaint, conciliation, chargeback, payment order or court. Do not threaten criminal reporting merely to force a civil refund.
  9. Use the correct help body. Consumer centres can advise; sector conciliation handles defined energy, telecom, finance, transport and other disputes; the universal body can cover eligible residual cases. Cross-border EU cases can use the European Consumer Centre.
  10. Assess litigation. Compare claim, evidence, limitation, defendant address, solvency, jurisdiction, court and lawyer cost, legal-expense cover and legal aid. After resolution, confirm refund or replacement, update payment disputes and subscriptions, delete access where appropriate, and retain the settlement.

Money and Deadlines

Calendar every contractual, statutory, payment-scheme and procedural clock independently.

A direct complaint, withdrawal declaration and warranty request are free. The consumer may pay tracked return shipping after withdrawal if properly informed; the trader pays necessary transport for statutory defect cure. Keep those shipping rules separate. Unauthorised cash-on-delivery, premium hotlines, paid complaint forwarding and unnecessary manufacturer diagnostics can be avoidable.

Run the deadline ledger

A covered distance withdrawal is generally 14 days. Goods commonly start after receipt and services after contract formation, subject to instructions and special branches. Missing or defective information can extend the period, but do not assume an extension without advice. A declaration sent on time preserves withdrawal; the separate return period also needs proof.

For faulty goods, notify promptly and allow repair or replacement within a reasonable time and without significant inconvenience. Germany's normal consumer-goods limitation is commonly two years from delivery, with special used-goods, building, digital and concealment branches. The first-year presumption concerns proof, not the total guarantee period. Negotiation may affect limitation only under exact law, so obtain a standstill or legal advice before expiry.

Subscription notice follows contract and mandatory rules. Covered websites need the statutory cancellation button. It must create a saveable timestamp and immediate text confirmation; if required buttons are absent or non-compliant, cancellation without notice may be available (cancellation button). Save the confirmation page.

Card chargeback and payment-service notices have provider, scheme and reason-specific periods, sometimes much shorter than civil limitation. Contact the issuer immediately. Direct debit, bank transfer, invoice and credit have different recovery tools. A bank fee or provisional credit varies by provider; get it in writing.

Consumer-centre advice and expert testing have regional or case-specific prices. Ask whether a fee is refundable, whether the trader agreed to the report, and whether litigation can recover it. Conciliation is commonly free for consumers, while lawyer and court cost depend on claim value and outcome. Legal-expense insurance can have exclusions and waiting periods; legal aid depends on means and merits.

The European Small Claims Procedure is primarily written and covers eligible cross-border civil claims up to EUR 5,000 excluding interest and expenses (EU legal action). Translation, service and enforcement can still cost money. German domestic payment-order and court routes have their own fees and objection deadlines.

Back-plan from the earliest limitation or scheme date: preserve the first complaint, escalate before the body cutoff, and leave time for legal filing. Do not wait for a police, BaFin or arbitration outcome if limitation is near.

Escalation Routes

Send the complete indexed file to the body with power over the exact trader and remedy.

Begin escalation only after a documented trader complaint unless urgent fraud, safety or a sector rule requires immediate reporting. Prepare the contract, amount, chronology, precise remedy, complaint and response, evidence index, current addresses, limitation date and any court or payment action. Do not send a document dump without explaining the requested outcome.

Route by sector and geography

For ordinary German goods and services, a Verbraucherzentrale can provide paid or free information depending on service and region. If a recognised sector body covers the trader, use it before the federal universal conciliation body. The universal body handles eligible residual consumer-trader disputes, generally without a lawyer and free for consumers, but the process is voluntary (consumer conciliation).

For energy, first complain in writing to supplier, network or meter operator. After no satisfactory response within four weeks and before court, apply to Schlichtungsstelle Energie. The procedure is free for consumers, companies must participate, and a proposal binds only if accepted (energy route).

For telephone and internet, use the provider complaint and then the Bundesnetzagentur telecom conciliation route for eligible disputes. Applications can be online or post. In August 2026 the body warned it was processing applications received around 35 weeks earlier, so do not let this queue consume court or limitation time (telecom conciliation).

For a bank, insurer, payment service or investment firm, complain to the firm's internal office and request a reasoned response. Use the relevant ombudsman or recognised conciliation body for the individual dispute. BaFin can examine supervised conduct for collective protection but cannot order an individual refund or give legal advice (BaFin complaint).

For package travel, complain promptly to the organiser, not only the hotel or airline. Identify whether it is a package or linked arrangement, performance failure, price change, cancellation, transfer, insolvency or extraordinary circumstance. The current EU route assigns organiser responsibility and insolvency cover for packages (package travel).

For another EU, Icelandic or Norwegian trader, ask the European Consumer Centre. For non-EU traders, assess jurisdiction, payment recovery and enforceable assets early.

If settlement fails, send a final pre-action demand and consider German payment order, ordinary civil court, EU small claims or another competent court. Preserve proof of service. Only a binding settlement, enforceable instrument or judgment compels payment; enforcement is a separate step.

Enforcement and Help

Separate recoverable consumer claims from criminal evidence, regulatory intelligence, and urgent payment security.

If a seller disappears, verify the legal entity and current address through invoice, imprint, marketplace records and official registers. Check insolvency notices and whether a successor, payment provider, platform protection or insurer is involved. Do not send further money to a recovery agent without verifying authority, fee and result. If insolvent, an ordinary complaint may need to become a creditor claim.

Marketplace confusion is solved contractually: identify seller of record, platform obligations, fulfilment carrier and payment recipient. Send the statutory defect claim to the seller while separately using platform protection before its deadline. A platform refund promise can be narrower or shorter than legal rights.

Respond to scams and coercive remedies

For a suspected fake shop, stop communication through suspect links, save the entire site, imprint, domain, offer, order, messages and bank details, and contact the bank or card issuer immediately. Police guidance flags implausible prices, prepayment pressure and trust seals that do not link to the issuer (fake shops). Change reused passwords, warn the bank about identity documents supplied, and file a police report. A report supports investigation but does not itself reverse payment or win a civil judgment.

A trader cannot force a voucher where the applicable law requires repayment after valid withdrawal, rescission, package cancellation or another money remedy. A voluntary return policy can lawfully offer store credit because it exceeds statutory rights. Identify which route applies before rejecting the voucher.

An unfair standard term can be ineffective if it unreasonably disadvantages consumers, hides core cost, excludes mandatory rights or conflicts with transparency rules. Continue paying undisputed amounts where appropriate, object in writing and obtain advice before withholding all payment or cancelling a direct debit. Consumer organisations can challenge systemic terms; an individual claim still needs its own resolution.

For a subscription trap, preserve the advertising, checkout button, order summary, confirmation, debits and cancellation page. Dispute whether a paid contract formed, declare withdrawal where available, cancel at the earliest and extraordinary date, use the statutory button, and object to unauthorised payment. Do not merely delete the app.

For urgent unsafe products, personal threats, identity theft or significant fraud, contact police or emergency bodies and the relevant market-surveillance authority while preserving the seller complaint. For high-value loss, injury, complex digital evidence, foreign jurisdiction, injunction, limitation, insolvency or court, use a lawyer promptly. Ask about advice assistance, legal aid, insurance and cost risk before litigation, then enforce any judgment through the competent route.
