Separate the two administrations

The autonomous-community public employment service registers the person as a jobseeker, renews the demand, provides placement and training, and monitors parts of the activity agreement. SEPE recognises and pays national unemployment benefit and subsidies. Registration with one does not automatically complete the other procedure. Keep both receipts and follow notices from both bodies.

Contributory unemployment protection is insurance based. It normally requires a legal unemployment situation, availability for work, jobseeker registration and at least 360 qualifying unemployment-contribution days in the relevant six-year window that were not used for an earlier right. The official duration table converts those days into 120 to 720 benefit days.

Map the alternatives

Someone with fewer than 360 days, or who exhausts contributory benefit, may qualify for a reformed unemployment subsidy if the route's income, family, age and contribution conditions are met. The over-52 subsidy adds retirement-pension qualification and annual income-declaration duties and includes pension contributions under its rules. Returned emigrants, victims of violence, released prisoners, temporary agricultural workers in Andalusia and Extremadura and other protected groups have specific routes.

An autónomo does not use ordinary employee unemployment merely because a business loses customers. Protection for cessation of activity has its own contribution, cause, evidence and managing-body rules. ERTE or RED reductions and suspensions, domestic employment, fixed-discontinuous inactivity and sea work also require their actual branch.

A dismissal can create unemployment without conceding that the dismissal was lawful. Protect the separate employment challenge. Voluntary resignation normally does not create legal unemployment, though a later genuine job and involuntary loss may require case-specific testing. Use contributory benefit when its threshold is met, the exact subsidy branch when it is not or is exhausted, cessation protection for qualifying self-employed cases, and social services or minimum-income support only through their separate tests. Verify the current route again whenever the work history or family situation changes.

Verify every condition before assuming a contract end or low income creates payment.

Establish legal unemployment

Dismissal, expiry of a valid temporary contract, qualifying collective measures, certain substantial employer breaches, a protected relocation or violence-related termination and other statutory events can create legal unemployment. A voluntary resignation ordinarily does not. A settlement document, finiquito or employer description cannot replace the actual facts. If dismissal is challenged, benefit can still be claimed without waiting for the court, while the employment case proceeds separately.

Check the effective end date and any paid but untaken holiday. The benefit filing clock and legal unemployment date can begin after the holiday-equivalent period. A fixed-discontinuous worker, part-time worker, temporary-agency worker, domestic employee or person with simultaneous jobs needs the branch matching the remaining work and contribution record.

Audit the insurance test

For contributory protection, count unused unemployment contributions in the six years before legal unemployment or the point at which contribution ceased. At least 360 days generally produces 120 benefit days. Previously consumed contributions cannot be reused. Work in another EU or coordinated country can be aggregated under applicable rules, but Spanish last-insurance and cross-border-worker rules matter. Obtain institutional U1 data rather than adding foreign payslips yourself.

Subsidies require the exact preceding event and current income test. SEPE assesses gross computable income under its rules, not simply bank deposits or taxable income. Some routes assess family responsibilities as well as personal income. The over-52 route requires the age threshold, unemployment registration, income condition and satisfaction of most contributory-retirement conditions other than age.

The claimant must be registered, available, legally able to work and committed to the activity agreement. Immigration permission can limit availability for third-country nationals. A pension, incapacity, sickness, birth benefit, study schedule, imprisonment, work or travel can suspend, replace or make protection incompatible depending on the case. Ask SEPE for the decision in writing when two statuses overlap rather than choosing whichever payment is higher.

Records

Build the Termination, Contribution, Jobseeker, Family, Bank, and Foreign-Insurance File

Reconcile employer, TGSS, regional service, and SEPE records before filing.

Assemble the core record

Keep DNI, NIE or passport, Social Security number, current address and contact details, claimant-owned bank account and valid work permission where relevant. Add every contract and amendment, termination or dismissal letter, finiquito, holiday calculation, last six or more payslips, work-history report and contribution-base report. Preserve schedules and bank credits if the employer's dates or salary are disputed.

The employer normally sends the company certificate electronically to SEPE. Obtain confirmation and check employer identity, cause and date of termination, contribution bases and paid holiday. If it is missing or wrong, ask for correction in writing and tell SEPE at filing. Do not let an employer certificate dispute consume the claim deadline.

Prove jobseeker and family facts

Save the regional demand-registration document, DARDE or equivalent, renewal dates, activity agreement, appointments and training attendance. Record the SEPE pre-application or application, exact submission, reference and signed receipt. A booked appointment alone may not prove filing.

For minimum or maximum amounts and subsidy eligibility, keep civil records and evidence for children or family responsibilities requested under the current rules. For income-tested routes, build a monthly gross-income schedule with work, pensions, benefits, rent, capital and business income, plus supporting tax and bank records. Explain exceptional receipts rather than omitting them.

For EU work, keep foreign insurance number, employer, dates, payslips, termination and U1 or institutional-exchange reference. The current SEPE EU route says information is mainly exchanged between institutions, but personal records help correct gaps.

Run a final consistency check across name, identifiers, employer, start, end, termination cause, holiday end, bases, children, income, bank and address. Preserve each notification with the date it was opened. Keep originals, upload legible copies, redact unrelated data and maintain a chronology of corrections and decisions. Add a contents page naming each document, issuing body, covered period and submission date so a reviewer can reconstruct the claim quickly.

Follow the claim sequence

  1. Record the event. Identify the effective termination, cause, paid holiday, remaining jobs, sickness or birth status and dismissal challenge deadline.

  2. Audit contributions. Download work history and bases, count unused unemployment days and obtain foreign institutional data where relevant. Request corrections immediately.

  3. Register as a jobseeker. Use the responsible autonomous-community service, accept the activity agreement and save the demand document and renewal date.

  4. Select the route. Choose contributory benefit, the exact subsidy, over-52 protection, agricultural protection or self-employed cessation based on facts. Do not submit multiple inconsistent claims.

  5. File with SEPE. Use the electronic office, recognised pre-application where current, appointment or public registry route. Include missing-employer or foreign-record explanations and keep a timestamped receipt.

  6. Check the decision. Verify start, duration, regulatory base, percentage, children, gross amount, deductions and first payment. Compare the 360-to-539-day band with the official duration table.

  7. Meet ongoing duties. Renew demand, attend calls, apply or train as required, remain reachable and report income, family, work, self-employment, illness, birth, pension, travel and address changes.

  8. Handle work before starting. Ask whether the new activity suspends, ends, reduces or complements payment. Request any compatibility within its deadline and confirm employer alta.

  9. Coordinate travel. Notify ordinary foreign travel and obtain U2 authorisation before an EU job-search export. Do not treat a flight booking as permission.

  10. Close or resume correctly. After work, return or another suspension ends, request resumption within the current route and choose between an old right and new entitlement where the option applies.

Maintain one calendar for demand renewal, SEPE requests, income declarations, work starts, travel, payment, appeal and employment litigation. After each change, download the updated decision and reconcile bank payments so an error is corrected before it becomes a large debt. Keep the next renewal and reporting date visible in a personal calendar.

Calculate duration and base

From 360 through 539 qualifying contribution days, contributory benefit lasts 120 days. Each published contribution band adds 60 benefit days until 2,160 or more contribution days produces the 720-day maximum. Only unused days in the relevant window count. Part-time contribution days and simultaneous employment require the official record, not an informal hours conversion.

The regulatory base generally uses the average unemployment contribution bases from the last 180 contributed days, excluding overtime. The gross benefit is normally 70 percent for the first 180 benefit days and 60 percent from day 181, then current statutory minimums and maximums apply. Social Security deductions and any IRPF withholding reduce bank payment.

Apply current 2026 amounts

The SEPE 2026 table publishes monthly contributory minimums of EUR 560 without children and EUR 749 with at least one child. Maximums are EUR 1,225 without children, EUR 1,400 with one child and EUR 1,575 with two or more. The legal child definition and average-hours rules must be checked in the decision. These are not salary guarantees.

For current ordinary subsidies, the published progression is EUR 570 for the first 180 days, EUR 540 from day 181 through 360 and EUR 480 thereafter where the route continues. The over-52 subsidy remains EUR 480 throughout under the 2026 table. Duration, income, family and renewal rules still differ by subsidy.

Budget gaps and options

Include the delay before first payment, lost bonuses, rent, healthcare or pharmacy costs, job-search travel, training, childcare, translations and optional adviser costs. Official registration and filing are free. Capitalisation can fund a qualifying activity, and some self-employment can be compatible, but both require a timely pre-start or post-start decision. Never pay an agent for guaranteed benefit or fabricated unemployment. Keep gross decision, deductions, bank credits and annual tax certificate, and set aside disputed overpayments until resolved.

Report the change first and obtain the correct suspension, compatibility, export, or resumption decision.

Test new work under current rules

Do not rely on old statements that every job is fully incompatible. For contributory claims and subsidies, test the benefit start date, work start, hours, income, contract and the post-1-April-2025 employment-support supplement rules. Some work suspends payment, some creates a reduced or complementary amount, and some ends entitlement. Notify SEPE and verify employer alta before starting.

A qualifying contributory claimant who starts self-employment can request compatibility for up to 270 days or the shorter remaining period, but the current compatibility route requires action within 15 days of the activity start. Capitalisation is different: it generally must be requested before starting and can finance justified investment or contributions. Compare cash flow, tax, RETA, unused benefit and failure risk before choosing.

Coordinate protected situations

Temporary incapacity beginning before or during unemployment, birth and childcare, permanent incapacity, retirement and survivor benefits can change payer, amount, contribution and duration. Report the event and obtain the benefit-specific decision. A contract ending during sick leave follows a different sequence from becoming ill after unemployment begins.

Export lawfully

For EU, EEA or Swiss job search, a claimant normally remains registered in Spain for four weeks, obtains SEPE authorisation and U2 before departure, and registers with the destination employment service within seven days. Export normally lasts three months and can be extended by another three only if authorised. The Spanish payment continues, but destination jobseeker duties apply. Return before expiry and request continuation correctly.

Ordinary travel, study, volunteering, family care and non-EU moves have different notification and suspension rules. On return or after a job ends, request resumption promptly. If new contributions create a fresh right, compare the statutory option and understand which contributions or remaining days are consumed. Save each suspension, compatibility, export, resumption and option decision. Reconcile the next bank credit with its effective dates before assuming the transition is complete.

Problems

Separate TGSS records, SEPE benefit review, regional jobseeker sanctions, and employment litigation.

Correct the owning record

For missing alta or contribution bases, file a TGSS correction with contract, schedules, payslips, bank credits, messages and work evidence. For undeclared work or false self-employment, use the Labour Inspectorate as well. Tell SEPE that correction is pending and provide the receipt, but do not assume it pauses the benefit deadline.

If the employer certificate is absent or wrong, request correction in writing and file with SEPE using the evidence available. If legal unemployment is disputed, preserve the termination facts. A dismissal challenge generally has a 20-business-day employment timetable, separate from SEPE review. Signing a finiquito does not necessarily waive every claim, but obtain advice before adding a broad settlement statement.

Challenge benefit and sanction decisions

For denial, wrong duration, base, family limit, late-start loss, suspension, sanction or overpayment, build a calculation and chronology. Read the notice for allegations, prior administrative claim, filing body and deadline. State each wrong fact, attach primary evidence and request a precise result. Keep the registry receipt. An appointment, phone call or regional complaint does not replace the SEPE filing. Social-court action can follow the required administrative stage.

For a demand-renewal or activity sanction, establish which employment authority made the decision and prove renewal, notice delivery, attendance or justified impossibility. For overpayment, obtain the period and calculation, challenge promptly if wrong, and request lawful instalments if correct. Do not ignore collection notices or pay a private rescuer.

Escalate urgent cases

Report identity theft, false contracts or coerced cash repayment to the appropriate authority. For immediate food, medicine, housing or safety risk, use municipal or regional emergency social services, healthcare, violence services or police while the claim continues. Worker representatives, unions, public employment advisers, legal aid and qualified labour counsel are proportionate for dismissal, cross-border aggregation, major overpayment, repeated record failure or an approaching court deadline. Bring the decision, full employment file, contribution reports, demand record, money calculation, notifications and earliest deadline.
