Tax Map
Map Resident IRPF, Non-Resident Tax, Special Regimes, Regional Taxes, VAT, Wealth, Gifts, and Treaties
Choose the tax system from residence, source, activity, assets, event, and regional connection.
Separate status from tax type
Ordinary Spanish tax residents generally pay IRPF on worldwide income for the complete calendar year. Non-residents use IRNR for Spanish-source income, often through model 210, and can owe property imputation even without rent. A qualifying worker, professional, entrepreneur, investor or family member can elect the displaced-person special regime: the person remains an IRPF taxpayer but calculates defined income under modified non-resident rules. It is not a declaration of non-residence.
Employment, self-employment, rent, interest, dividends, gains, pensions, imputed property income, prizes and income attribution have distinct classification and expense rules. VAT, Corporation Tax, payroll withholding, local business and municipal taxes operate separately from personal IRPF.
Map assets and events
Wealth Tax assesses net assets at 31 December, subject to state valuation and autonomous-community exemptions, allowances and rates. The solidarity tax for large fortunes complements it where net wealth exceeds the statutory level and tax remains due. Foreign accounts, securities and property can create model 720 information duties; crypto held abroad can have a different information return. These do not replace income or gain reporting.
Inheritance and Gift Tax falls on the recipient, with management and regional law driven by residence and asset connections. Buying, owning and selling property can involve transfer tax or VAT, stamp duty, municipal property tax, imputed income, rental income, capital gain and municipal land-value tax.
Treaties resolve dual residence and allocate taxing rights, but usually require the taxpayer to claim exemption or credit with proof. Social Security contribution residence is a separate coordination question. Choose ordinary IRPF only after residence is established, the special regime only through a valid timely option, IRNR for true non-resident Spanish-source items, and event-specific regional or municipal filings for assets, gifts and property. Treat each duty as a separate decision with its own taxpayer, taxable event, valuation date, return, payment deadline and competent authority.
Tax Residence
Determine Calendar-Year Residence, Treaty Residence, Special-Regime Eligibility, and Autonomous-Community Connection
Apply all domestic tests and treaty tie-breakers before selecting forms or withholding.
Apply Spanish domestic tests
The official residence test treats a person as resident where any statutory test applies: more than 183 days in Spain during the calendar year, principal centre or base of economic activities or interests in Spain, or the rebuttable presumption from a non-separated spouse and dependent minor children residing here. Sporadic absences generally add to Spanish presence unless foreign tax residence is proved.
Spain generally does not split an ordinary individual's tax year on arrival or departure. A person is resident or non-resident for the whole year. Keep a day calendar with arrival and departure evidence, homes, work locations, family, business, investments and spending. Padrón, visa, TIE, NIE and a foreign certificate are evidence but none alone controls every test.
Resolve dual residence and regime choice
If another country also treats the person as resident, apply the treaty sequence, commonly permanent home, centre of vital interests, habitual abode, nationality and mutual agreement. Obtain the other country's residence certificate for the correct period. Treaty residence does not eliminate Spanish-source filing automatically.
The special displaced-worker regime requires a qualifying move, prior non-residence period, permitted employment, remote, entrepreneurial or professional cause, and compliance with exclusions and income rules. The 2026 model 149 timetable generally gives the principal taxpayer six months from activity start. Family members file individually and have their own entry and relationship tests.
Finally determine autonomous-community residence under presence, interests and family rules, guarding against tax-motivated temporary moves. This connection affects the regional IRPF scale and deductions, Wealth Tax, gifts and inheritance. Obtain specialist advice before the model 149 deadline, a major asset sale, trust distribution, relocation or year with conflicting homes. Reperform the tests every calendar year because travel patterns, family location, employment, business control and available homes can change the answer. Document the conclusion and contrary evidence.
Tax Records
Create a Worldwide Income, Asset, Debt, Day, Withholding, Treaty, and Regional Evidence File
Reconstruct every calendar-year fact in euros with source documents and exchange rates.
Build the residence and identity file
Keep DNI, NIE or passport, NIF, tax address, padrón, leases or deeds, utility evidence, travel calendar, tickets, border and work records, family location, business and investment ties, and foreign residence certificates. Record the autonomous community where days and main interests fall. Preserve model 030 address changes, model 149 option and certificate, employer form 145, census and Social Security records.
Inventory income and assets
For each country, list employment, self-employment, rent, pensions, Social Security benefits, interest, dividends, funds, shares, options, crypto, property, insurance, trusts, partnerships, companies, loans, gifts and gains. Keep gross statements, withholding, expenses, purchase and sale dates and cost basis. Include accounts with ownership, beneficial ownership, authority or joint status where information rules require them.
Record original currency and the official conversion method and rate used. Preserve foreign tax assessments, filed returns and payment receipts, not only broker withholding. For property, keep purchase deed, taxes, notary and registry costs, improvements, depreciation, rent, vacancy, mortgage and sale costs. For investments, retain corporate actions, transfers and reorganisations so cost basis survives a broker move.
Create the reporting matrix
Map each item to ordinary IRPF, special regime, IRNR, model 720 or crypto information, Wealth Tax, solidarity tax, inheritance or gift, VAT, business or municipal duties. The model 720 scope is category specific and informational; it does not declare income.
Reconcile employer and bank data with AEAT tax data, but do not assume the draft contains foreign items. Keep ownership charts, marriage-property records and valuations at 31 December. Index all evidence, calculations, advice and filing receipts by year and preserve records beyond the normal period where cost basis or carried losses remain relevant. Record who supplied each figure, when it was checked, any estimate used, and what later document must replace that estimate before filing. Keep an unresolved-items checklist.
Action Plan
Decide Residence, Choose the Regime, Correct Withholding, Track Worldwide Items, and File Every Required Return
Complete the tax analysis in dependency order and preserve proof for every classification.
Follow the annual sequence
-
Create the day and ties file. Track every presence day, sporadic absence, home, family, work and economic-interest fact from 1 January.
-
Test domestic and treaty residence. Determine whole-year status and autonomous-community connection. Obtain foreign certificates and treaty analysis where dual.
-
Compare tax regimes. Model ordinary IRPF and the displaced-person special regime over the full permitted period, including foreign income, wealth, family and exit consequences. File model 149 on time if chosen.
-
Align registrations. Verify NIF, tax address, form 145, employer payroll, form 036 for activity and Social Security. Registration does not replace residence analysis.
-
Build the worldwide ledger. Record all income, gains, accounts, assets, debts, gifts, foreign tax and exchange rates. Track purchase cost and carried losses.
-
Correct prepayments. Review payroll withholding, professional retention, IRPF instalments, rental withholding and non-resident forms. Reserve cash for final liability.
-
Test information and asset taxes. Evaluate model 720 or crypto reporting, Wealth Tax, solidarity tax and any regional or municipal filing independently.
-
Prepare the annual return. Import AEAT data, then reconcile it with employer, bank, broker, foreign and business records. Select individual or joint filing only after a household comparison.
-
Claim treaty relief. Classify each foreign item, attach or retain proof, apply exemption or credit limits and pursue foreign refunds where the treaty assigns tax differently.
-
File, pay and archive. Use the correct model and year, save the signed return and receipt, verify debit or refund, and monitor notices.
After filing, reconcile assessment, bank and carried balances. Update the next-year withholding and reserve. Never confirm a draft solely because the result is a refund; missing foreign income or assets can make a favourable draft wrong. Open every electronic notice promptly, record its effective service date, and route any discrepancy to the correct amendment or appeal process.
Tax Cost
Budget Progressive Income Tax, Regional Differences, Foreign Credits, Wealth, Property, Gifts, Advice, and Cash Flow
Model total household tax under the actual region, regime, income type, and asset ownership.
Model income by category
IRPF is progressive and combines state and autonomous-community scales, allowances and deductions. General income can include employment, pensions, property and business results; savings income can include defined interest, dividends and gains. Classification, not payment account, determines treatment. Joint filing is an annual family option, not a universal lower rate.
Withholding and instalments are prepayments. A foreign tax credit is generally limited to the lower treaty and Spanish calculation for the same income and can require source-by-source evidence. Excess foreign withholding may need refund abroad. Social Security contributions are separate from tax and do not automatically produce an equal deduction.
Add asset and event taxes
The Wealth Tax service applies valuation and exemption rules at 31 December, with regional variation. Solidarity tax addresses net wealth above EUR 3 million and coordinates with Wealth Tax. Model 720 can require reporting even when no wealth tax is payable.
Property can create purchase VAT or transfer tax, stamp duty, annual municipal property tax, non-resident imputation or resident income, rental tax, capital gain and municipal land-value tax. Gifts and inheritances vary dramatically by relationship and regional connection. Investment disposals, options, crypto exchanges, company shares and trusts need specialist basis and timing work.
Budget compliance and uncertainty
Include translations, foreign certificates, valuations, appraisals, broker reconstruction, tax software and professional advice. Official filings are generally free, but payment, guarantees and late interest are not. Build low, central and high liability cases, reserve separately from spending money and retain funds for delayed foreign credits or RETA regularisation. Seek written advice before model 149, a large gain, trust distribution, gift, inheritance, company exit, property sale or move between regions or countries. Recalculate after bonuses, investments, exchange-rate changes, family events or a regional move instead of relying on the prior year's effective rate. Refresh the forecast quarterly.
Transitions
Manage Arrival, Job or Business Changes, Family Events, Regional Moves, Asset Sales, Departure, and Exit Tax
Re-test residence, regime, withholding, reporting, and asset consequences before the change takes effect.
Re-test material changes
A new employer, self-employment, remote-work country, unemployment, pension, marriage, separation, child, inheritance, gift, home purchase, rental, business sale or regional move can change classification, withholding, deductions and information duties. Update address and payer data, but do not confuse an administrative update with a residence conclusion.
A special-regime taxpayer must report exclusion within the current route after a condition fails, and renunciation and end of displacement use different windows. Family eligibility can end separately. Model the remaining regime years before changing employer, director role, entrepreneurial certification or foreign-work pattern.
Autonomous-community residence affects the year under statutory day and interests rules. Artificial short moves can be disregarded. Preserve housing, work and family evidence for a genuine move. Before selling investments or property, gifting assets, exercising options, moving a company or receiving foreign pension capital, calculate both countries and treaty timing.
Plan departure before travel
Spain usually treats the person as resident or non-resident for the whole calendar year, so departure date alone does not split the year. Build a future-year day plan, home and work evidence, foreign residence certificate, treaty analysis, tax address and pending return schedule. Decide how Spanish property, bank, business, pensions and withholding continue under IRNR.
The exit-tax rule can tax latent gains on qualifying high-value shareholdings when a long-term resident ceases residence. Destination, values, later sale and communications affect relief or deferral. Obtain valuation and advice before moving.
After every transition, revise the worldwide inventory, withholding, instalments, information returns, wealth and regional connection. Keep a final Spanish filing calendar, electronic-notice access and funds for assessments after departure. Preserve Spanish and destination-country advice together so both sides use the same dates, values, ownership facts and treaty assumptions. Close or change direct debits only after every return, assessment and refund has cleared, and keep a stable correspondence address for later authority questions.
Problems
Correct Wrong Residence, Missing Foreign Items, Draft Errors, Late Information Returns, Double Tax, Assessments, and Fraud
Reconstruct the facts, use the correct correction or appeal route, and protect collection deadlines.
Reconstruct before correcting
For a residence dispute, build the full day, absence, home, family, work, economic-interest, foreign certificate and treaty file. A passport-stamp count alone is incomplete. For a special-regime problem, establish activity start, option date, eligibility, family entry and any breach. Missing the option deadline is not normally cured by choosing the regime in an annual return.
For omitted income, gains, accounts or assets, identify every affected year and model, original filing, tax, interest and potential penalty. Use the current self-correction or rectifying return route. Do not file random duplicates. Model 720 and wealth filings are separate from IRPF, so correcting one may not fix another.
Challenge the exact decision
For denied foreign credits or deductions, provide treaty classification, foreign assessment, payment, source, exchange rate and Spanish limit calculation. For an AEAT proposal or assessment, respond within the allegations, reconsideration or economic-administrative deadline stated. A later court route can follow. Filing review does not always suspend collection; assess payment, deferral, instalment or guarantee separately.
For inheritance, gift or regional disputes, verify the competent state or community body before appealing. For non-resident property or withholding, use the income-specific model and period. Keep every electronic notice and proof of opening.
Respond to fraud and hardship
Revoke compromised certificates and powers, notify AEAT and banks, and report identity theft, fake refunds or altered accounts. A paid adviser does not transfer taxpayer responsibility; obtain filed copies and challenge negligence separately. Never buy a residence certificate, hidden-account scheme or guaranteed amnesty.
Use AEAT assistance, regional tax offices, treaty competent authorities, legal aid and qualified cross-border tax counsel according to scale. Bring the residence chronology, worldwide ledger, filings, decisions, calculations, payment evidence, desired remedy and earliest deadline. For unpayable debt, seek formal payment options before enforcement rather than ignoring notices. Keep a deadline register with service evidence because a strong substantive case can still fail when the available procedural route expires.
