Separate advice, appointment, and funding
A Colegio de la Abogacía runs a Servicio de Orientación Jurídica, or SOJ, that explains eligibility, helps complete a legal-aid request and performs initial viability review. Formal asistencia jurídica gratuita is decided through the statutory bar, procurator and Legal Aid Commission process and can fund specified representation and expenses. A lawyer assigned at a police station, emergency court or duty rota protects immediate defence rights, but the person may still need to apply and can owe fees if aid is later refused.
Workers and Social Security beneficiaries use labour protections, unions or the labour SOJ for employment and benefit disputes. Consumers can start with OMIC, a regional consumer body or arbitration. Tenants can use municipal housing mediation or a tenant organisation. Immigration, asylum, gender-violence, disability, equality and trafficking services include specialist public or accredited organisations. An ombudsman can examine public-administration conduct but does not replace a time-limited appeal or suspend enforcement.
Choose the route by outcome
Use police or emergency counsel for detention, violence or immediate criminal process; the court and urgent specialist lawyer for injunctions, eviction, child protection or expiring appeals; SOJ for formal legal-aid screening; a union for covered labour work; a consumer body for trader redress; insurance-appointed counsel where a policy covers the event; and a qualified private lawyer for advice outside any free scheme. Cross-border civil disputes can use the EU legal-action overview and transmitting legal-aid authorities.
National law defines core legal aid, while autonomous communities administer commissions and services in transferred territories and local bars set appointments and document channels. Municipality and NGO coverage varies. The judge controls the case; the bar makes provisional professional designations; the Commission confirms or denies the statutory right.
A claimant with a live lawsuit should protect the filing and request suspension where lawful while applying. A person only needing a contract review should compare fixed-fee private advice, insurance, union or clinic. A victim in a protected category should use the specialist route without assuming an income test. A routine consumer or administrative complaint should exhaust the competent free complaint service before funding litigation.

Apply the legal test in force on the application date and disclose both income and patrimony.
Calculate the ordinary economic ceiling
The consolidated Legal Aid Act tests gross annual resources from all sources and sufficient patrimony. A person outside a family unit is ordinarily limited to two annual IPREM. A family unit with fewer than four members uses two and a half IPREM; a unit of four or more, or a legally recognised large family, uses three. Registered partners are treated like non-separated spouses for the statutory family-unit concept.
The published 2026 annual IPREM is EUR 7,200. That makes indicative ordinary income ceilings EUR 14,400, EUR 18,000 and EUR 21,600 respectively. These are not automatic approvals. The Commission also reviews property, savings, vehicles, business interests, external signs, unusual expenses and whether the applicant truly lacks resources to litigate. Recheck IPREM on the actual application date.
Test the personal and case branches
The claim must generally concern the applicant's own rights and cannot be legally indefensible. Conflict within a family unit can allow separate economic assessment where interests oppose. Exceptional recognition can reach resources up to five IPREM for specified family, health or disability circumstances, with insufficient patrimony and a reasoned decision specifying benefits.
Workers and Social Security beneficiaries have special entitlement for defending labour and Social Security rights. Victims of gender violence, terrorism and human trafficking, and specified minors or persons with intellectual disability who are victims of abuse, can qualify for proceedings linked to that status without the ordinary resource test. Criminal defendants, detained people, asylum applicants and foreigners have distinct defence and jurisdiction guarantees; nationality alone is not a bar.
Check whether lawyer or procurador participation is legally required or necessary because the opposing party uses counsel. Inspect home, vehicle, travel or professional legal-expense insurance, union membership and employer indemnity before claiming public funding, because existing coverage matters. For a cross-border EU dispute, identify residence, court, applicable transmitting authority and whether Spanish or foreign legal-aid rules decide the application.
The SOJ performs initial review, the professional bodies can make provisional designations, and the competent Legal Aid Commission issues the formal recognition or denial. Use the official calculator only as an indicator and disclose every requested fact accurately.

Prove economic need and give counsel enough substance to protect the actual legal position.
Prove identity and household
Prepare DNI, NIE, passport or residence card; current address and padrón; marital or registered-partner status; separation or divorce evidence; children and dependants; disability or large-family recognition; and any protected-victim record relevant to the special branch. A foreign identity or civil record may need sworn translation where the receiving body cannot assess it, but ordinary applications do not justify unnecessary legalisation.
For every relevant family member, gather the latest IRPF return or non-filing certificate, payslips, employment contract, employer annual-income certificate, pension and benefit certificates, unemployment periods and amounts, self-employment books and company interests. Add recent bank and investment balances, cadastral certificates, Land Registry notes, property use and mortgages, vehicles and recurring income. Explain exceptional medical, disability, care, housing or dependent costs with invoices and decisions.
Build the legal chronology
Include the challenged contract, administrative decision, claim, summons, police papers, court order, eviction or dismissal notice, prior complaints and responses. Mark the authority, case number, service date, procedural stage, next act and deadline on a one-page chronology. Preserve envelope, electronic-notice download, secure verification code and proof of any filing. Add opposing-party identity and contact, witnesses and evidence location.
Bring legal-expense insurance, policy conditions, insurer acceptance or refusal, union membership, consumer-arbitration position and any prior lawyer engagement. Disclose related proceedings and conflicts. A private opinion is not usually required to apply, but facts must show a sustainable claim.
The official application guidance lists indicative evidence, while the competent SOJ specifies what this file needs. If a certificate cannot arrive before a deadline, submit the application and available substitute evidence, identify the requested issuer and date, and ask in writing for a cure period. Failure to cure can close the file.
Use copies unless an original is expressly required, obtain a receipt for anything surrendered, redact unrelated sensitive material and use the bar's secure channel. Finish by matching names, NIFs, family members, annual periods, gross figures, asset ownership, case number and deadline across the form and evidence.

Follow the procedural sequence

Triage danger and deadline. Call emergency services for immediate harm and seek duty counsel for detention or urgent court action. Record every live expiry.

Identify the competent forum. Determine criminal, civil, family, labour, administrative, immigration, consumer or cross-border jurisdiction and the court or authority handling it.

Use the narrow free route. Contact a union, consumer office, housing service, specialist NGO, equality body or ombudsman where it can solve, mediate or prepare the issue without litigation.

Check existing cover. Notify legal-expense insurance and the union promptly. Obtain a written scope or refusal rather than assuming cover.

Prepare the application file. Complete household, income, asset, special-status and case evidence. State the exact proceeding and requested benefits.

Apply to SOJ or court. File through the competent bar association's orientation service or the court route that forwards it. Save the signed application and timestamp.

Protect the live case separately. File the procedural act if possible and request court or authority suspension under the specific rule. Attach the legal-aid receipt and explain the risk of forfeiture.

Answer cure requests. Supply missing documents by the stated date and keep proof. Ask for clarification in writing where the demand is impossible or irrelevant.

The free SOJ service provides initial guidance and application help. Local appointment, online and in-person arrangements vary. A representative needs valid authority; detained or court-summoned applicants follow the immediate route. After approval, notify any privately instructed professional and insurer without creating duplicate mandates. After denial, obtain advice before assuming the appointed lawyer remains free.

SOJ orientation and the legal-aid application are free. Formal recognition can cover pre-proceeding advice, lawyer defence, procurador representation, assistance to detained people, defined expert evidence, notices and publications, registry or notarial documents and fee reductions or exemptions where statutory conditions apply. The Ministry overview summarises lawyer, procurador, expert, bond and fee branches, but the actual decision controls this applicant's benefits.
A duty lawyer is not automatically cost-free. If legal aid is denied or not requested, professional fees can become payable. Likewise, privately choosing a professional, commissioning an expert without authorisation, ordering extra translations, travelling, obtaining certificates or pursuing work outside the covered proceeding can create personal cost. Request written confirmation before spending.
Calculate the 2026 eligibility reference
The current IPREM table gives EUR 600 monthly and EUR 7,200 annually for 2026. The ordinary two, two-and-a-half and three-IPREM ceilings are therefore EUR 14,400, EUR 18,000 and EUR 21,600 gross annual resources for their respective household categories. Do not use the EUR 8,400 fourteen-payment figure without confirming the legal-aid calculation basis. Assets and special rules remain decisive.
Existing legal-expense insurance can involve a deductible, panel lawyer, freedom-of-choice limit, notification deadline or excluded dispute. Unions and associations can restrict cover by membership date or subject. A fixed-fee private consultation may be proportionate where litigation is unlikely, the issue falls outside legal aid or a rapid second opinion prevents greater cost. Obtain scope, VAT, disbursements and cancellation terms.
Legal aid does not promise victory or erase the opposing party's rights. Adverse-cost treatment, recovery from a successful award, improved financial circumstances, false disclosure and retrospective revocation have statutory consequences. A funded expert or translation can require prior approval. Court enforcement after the covered stage and an appeal outside scope may need confirmation.
Maintain a cost ledger with public coverage, insurer coverage, private commitments, disbursements, adverse-cost exposure and recoverable amounts. Never pay an intermediary to guarantee approval, buy a duty appointment or transfer money to an alleged court account without verifying it through the official body.
Deadlines and Changes

Protect the underlying case
The legal-aid application does not automatically suspend a court case or administrative file. Under the current statutory suspension rule, the judicial officer or administrative body can suspend to prevent forfeiture or defenselessness where the request was made within the applicable procedural period and appointment is required. File a specific suspension request with the application receipt and continue complying unless an order says otherwise.
Prescription for a claim that must be started can have a separate statutory interruption mechanism tied to a timely legal-aid request and a maximum period. Do not generalise that rule to every appeal, answer, conciliation or enforcement deadline. Mandatory pre-action negotiation introduced for many civil claims also needs its own proof and timing analysis; funded assistance may cover it where later representation would be required or the opposing party uses counsel.
Track decisions and status changes
Calendar SOJ appointments, document cure, provisional lawyer and procurador appointment, Commission decision, challenge, court filings, hearings, settlement steps, judgment and enforcement. Legal aid generally continues through the recognised instance and appeal under statutory conditions, and can extend to execution begun within the specified post-decision period, but confirm the award and new court. A new, unrelated case needs its own analysis.
Report job, income, inheritance, asset, household, address, insurance and protected-status changes when required. Separation or an interest conflict can change the family-unit calculation. Moving between provinces can change the administering bar or Commission but does not move an existing court automatically. Keep counsel and the court updated through formal channels.
For a cross-border EU matter, determine which country receives and transmits the application, which law assesses resources and which expenses arise abroad. Translation and foreign service can require prior approval. Moving away does not erase a Spanish deadline or representation duty.
Backward-plan from the first legal deadline: obtain SOJ contact immediately, file the application and suspension request early, cure documents before the bar date, deliver the case file on appointment, and review the Commission notice on service day. Before settlement, appeal or enforcement, ask counsel in writing whether the act is within coverage and what personal cost or deadline remains.

Fix access without losing the case
For a missing-document notice, list every requested item, obtain it from the issuer and file by the cure deadline with a receipt. Where impossible, provide substitute evidence and a written explanation rather than silence. If the wrong SOJ or court received the request, ask for formal transfer and separately protect the substantive deadline in the competent forum.
For delay, obtain the application and expediente number, provisional decision and Commission status. Do not assume silence equals approval or that an unconfirmed appointment can act. If no lawyer has contacted the applicant, send the full chronology to the bar and court, identify the imminent act and request urgent coordination.
A Commission denial can be challenged through the statutory route stated in the notice. Preserve service date, application, evidence and provisional position. Obtain advice on whether the appointed professionals remain involved and whether fees are now due. If resources exceed the ordinary ceiling, ask whether exceptional recognition, conflict-based separate assessment or protected-category entitlement was properly considered.
Address professional and safety failures
For communication breakdown, conflict or serious conduct concern, write to counsel with the case number, requested action and deadline. A client cannot simply replace appointed counsel privately and assume coverage transfers. Use the bar's formal change, complaint or disciplinary route, while another professional may be needed urgently to preserve the case. Fee disputes and negligence claims are separate from correcting the live proceeding.
Request an interpreter, accessible format or accommodation from the police, court, bar or service as early as possible. Do not sign material that is not understood. For violence, detention, eviction, child removal, expiring limitation or threatened enforcement, contact emergency or duty services and the competent court immediately; an ombudsman complaint is not an injunction.
Verify every lawyer and payment request through the bar or court. Report fake appointments, forged judgments, advance-fee scams and stolen identity to the body and police. Use the free SOJ, Commission, court information office, legal aid, union or specialist NGO according to the failure. Bring the application receipt, decision, lawyer details, full chronology, communication record, desired remedy and earliest deadline.
