Map Nationality, Purpose, Family, Work, and Time in Spain to the Right Route
EU free movement and purpose-specific third-country routes lead to different applications and rights.
Spain's first division is nationality. An EU, EEA, or Swiss citizen staying longer than three months uses the EU registration framework. The person proves employment, self-employment, or sufficient resources plus comprehensive health cover and requests the Central Register certificate. A qualifying non-EU family member uses the EU-family card procedure, not the EU citizen's certificate.
A third-country national uses a purpose-specific route. The official residence index should lead to the exact current information sheet. The main branches are:
- Non-lucrative residence: for living from sufficient resources without employment or professional activity. The initial route is consular.
- Employed work: normally initiated by an employer for a qualifying non-resident worker.
- Self-employment: for an evidenced, viable activity with required licences, qualifications, investment, and funding.
- Family: the correct branch depends on whether the sponsor is Spanish, an EU free-movement citizen, or a third-country resident.
- Study: a long study stay has its own authorisation and work conditions. It should not automatically be counted as ordinary residence for every later procedure.
- Exceptional circumstances: routes such as social arraigo are filed from Spain only when their specific history and integration conditions are met. They are not general visitor conversions.
- Strategic mobility: the Large Companies and Strategic Groups Unit handles defined highly qualified, EU Blue Card, researcher, intra-company, entrepreneur, audiovisual, international teleworker, and family cases.
- Long-term residence: qualifying lawful continuity can eventually lead to indefinite residence and work.
Select by facts, not by the easiest appointment
Write down nationality, present country, current Spanish status, intended activity, employer or business, family sponsor, qualifications, available funds, insurance, prior Spanish residence, absences, and any pending protection case. Then compare the scope, filing place, work rights, and activation conditions of each plausible sheet.
A residence authorisation is the legal status. A national visa permits the relevant journey where required. Social Security registration can activate some work permissions. The TIE is the physical evidence issued after the qualifying grant. The NIE is merely the foreigner's identifying number. Choosing a form or obtaining an NIE does not create residence or work rights.
Eligibility

Each route combines common immigration conditions with evidence unique to the intended activity or relationship.
Eligibility begins with where the applicant is and what status they hold there. Many initial routes are designed for a non-resident applicant and require a Spanish consular process. Other routes expressly allow or require filing in Spain. Do not enter as a visitor expecting an automatic conversion. Match the intended filing date to the live sheet, including any rule against irregular status or any minimum lawful or continuous presence.
EU citizens staying beyond three months qualify through work or self-employment, or through sufficient resources and comprehensive health insurance. Their qualifying non-EU family members prove both the family relationship and the EU citizen's exercise of free movement. Third-country routes then add their own purpose test.
For non-lucrative residence, the applicant must support the household without work and hold qualifying insurance. Employed work requires a genuine compliant contract, an eligible worker and employer, and any applicable labour-market condition or exemption. Self-employment requires permissions or qualifications for the activity, a viable plan, investment and means. Study requires admission to an eligible activity, funds, insurance, and the correct education branch. International telework requires remote work for foreign enterprises, qualifying employment or professional history, income, insurance or Social Security coverage, and strict limits on Spanish clients for self-employed holders.
Family and exceptional routes are exact categories
The Spanish-family residence sheet lists qualifying spouses, registered or proven stable partners, descendants, ascendants, carers, and other dependent relatives under defined conditions. A family bond that feels equivalent is not enough if it falls outside the legal category or lacks the required dependency, cohabitation, custody, or support evidence.
Current social arraigo normally requires at least two years of continuous presence with no more than 90 days of absence, plus either qualifying family ties and means or a favourable integration report. Time as an asylum applicant is treated separately by the current rules. It is not a shortcut for someone who has just arrived.
Common conditions can include a valid passport, no disqualifying criminal record, no entry ban, no applicable no-return commitment, no public-order or public-health threat, and payment of the proper fee. Medical certificates, housing, integration, professional licensing, and adequate insurance appear only where the route requires them.
Finally, read the authorisation's work clause. Non-lucrative residence prohibits professional activity. Work, family, strategic, study, and exceptional routes confer different rights and conditions. A pending filing does not create work permission unless the particular law expressly says it does.
Documents
Prepare the Correct Form, Passport, Civil Records, Funds, Insurance, and Purpose Evidence
A reliable file connects every document to one requirement in the current official information sheet.
Create an evidence table from the exact official sheet. Put each requirement in the first column, the supporting document in the second, its issue and expiry dates in the third, and authentication, translation, copy, and original requirements in the fourth. This catches a common failure: having many documents but no evidence for one decisive condition.
The core pack commonly includes the signed route-specific EX form, complete valid passport and copies, photographs where required, proof of lawful status in the consular country, and representation evidence for a child or authorised representative. Some routes require criminal record certificates from countries of residence during a stated lookback, a medical certificate, or evidence about prior Spanish status. Use the sheet's precise period and wording.
Purpose evidence then separates the routes. Non-lucrative applicants show accessible financial means and qualifying private or public health cover without disallowed cost sharing. Employed files show the signed contract, employer identity, tax and Social Security compliance, solvency, job conditions, worker qualifications, and labour-market branch. Self-employed files show licences, professional recognition, investment, business plan, financing, and projected viability. Family files show current civil status, relationship, sponsor nationality and residence, dependency, custody, cohabitation, or support as their category demands. Study files show admission, programme and payment details. Arraigo files document every part of the continuous-presence period plus family and means or integration.
Authenticate and translate the right records
Foreign public records may need a Hague Apostille, diplomatic legalization, or an exemption. The Foreign Ministry's legalization guidance explains that some public documents covered by EU Regulation 2016/1191 are exempt and may use multilingual standard forms. Do not apostille blindly. Confirm what the receiving consulate or immigration office accepts.
A translation by a sworn translator certified by the Spanish Foreign Ministry is official in Spain without another legalization by that ministry. Translation does not fix an unauthenticated original, expired certificate, inconsistent spelling, missing page, or wrong issuing authority. Match every name, date, place, passport number, marriage or birth fact across records and explain legitimate differences.
Fees are evidence too. Preserve the completed fee form, bank validation or permitted electronic receipt, amount, item, payer, and payment date. Keep a complete indexed copy of the submission, official registry receipt, appointment confirmation, any request for more evidence, the response, and delivery proof. These records are essential for tracking, renewal, silence, appeal, and proving a timely filing.
Steps
File with the Correct Consulate or Immigration Authority, Then Complete Activation and TIE
The process can include authorisation, national visa, entry, Social Security registration, and a personal card appointment.
- Identify the exact current sheet. Confirm route, applicant, sponsor, location, form, authority, fee code, deadline, work effect, and whether the authorisation or visa is filed first. Save the dated page or PDF used.
- Choose the competent channel. A consular route uses the Spanish mission responsible for the applicant's lawful residence. An in-Spain route normally uses the competent Immigration Office, a specified ministry unit, or the enabled electronic system. The employer files many initial employed cases; the foreign national personally files other routes.
- Prepare and pay correctly. Complete the form without unsupported blanks, index the evidence, and pay the exact fee item by the required deadline. A consular visa fee, residence-authorisation fee, work-authorisation fee, and later TIE fee are different charges.
- Submit and capture proof. For a listed online procedure, Mercurio can accept an initial application, renewal, or documents for a pending file. Authentication alone is not submission. Finish the signature and transmission and download the official registry receipt, timestamp, file number, and document list.
Move from decision to active status
- Monitor the proper channel. Watch the case portal and official electronic-notification channel, not only email. Answer a request for correction or further evidence within its stated period and preserve proof. Do not assume that silence means approval; the legal effect is procedure-specific.
- Complete the visa stage where required. After a favourable initial authorisation, apply for and collect the national visa within the route's period, inspect it, enter within its validity, and retain entry evidence. Consular routes that decide residence and visa together still have collection and entry deadlines.
- Activate work if the route requires it. An employed or self-employed authorisation may depend on timely Social Security registration after entry. The Social Security number and actual alta are different facts. Keep the registration confirmation and notify the competent office of any route-specific change.
- Request the TIE personally. A person authorised for more than six months generally applies within one month of entry or the authorisation becoming effective. The police appointment normally requires EX-17, passport, photograph, grant or visa evidence, current fee proof, and Social Security activation where applicable. Fingerprints and later collection are personal.
The TIE proves the underlying administrative position but does not replace the passport. Its validity cannot exceed the authorisation. After collection, check name, NIE, category, work wording, dates, and remarks immediately. Then complete related tasks such as padrón, healthcare access, tax registration, and digital identity according to the person's actual circumstances.
Costs & Timing
Budget Separate Authorisation, Visa, Work, TIE, Record, Translation, and Insurance Costs
Fees and decision periods belong to particular stages and do not include document preparation or appointments.
Build a stage-by-stage budget, not one line called residence fee. Depending on the route, the case can include a consular national-visa fee, a 790-052 residence-authorisation item, a work-authorisation item, and a police TIE fee. A spouse or another family member can have a separate application and fee. The Spanish-family residence authorisation procedure itself is currently free, but document, travel and TIE costs can still arise.
The Interior Ministry's current immigration document fee table showed, when checked on 25 August 2026, EUR 16.08 for a first temporary-residence TIE, EUR 19.30 for a renewal TIE, and EUR 21.87 for a long-term-residence TIE. These dated figures are not a promise for a later appointment. Generate the correct current form and item immediately before payment, and make sure the bank or online receipt identifies the payment properly.
Add the cost of producing acceptable evidence
Budget passport renewal, civil and criminal certificates, certified copies, Hague Apostilles or legalization, sworn translations, medical examination, photographs, travel to a consulate or police unit, courier, and replacement records. Non-lucrative, student, and some family applicants may need months of qualifying insurance. Work and business cases can require professional recognition, licences, company records, viability reports, advice, or Social Security contributions. Strategic and telework routes have their own current fees and income tests.
Never pay an unofficial seller for an appointment or a guaranteed decision. Professional advice may help a complex case, but no representative can waive statutory eligibility or control the outcome. Ask for a written scope and invoice.
Timing also has layers: obtaining foreign records, appointment wait, admissible filing, correction requests, administrative decision, visa application and collection, entry, Social Security activation, TIE appointment, and card collection. The official decision period begins under the procedure's rules, not when research or appointment hunting starts. For example, the Spanish-family route states two months and social arraigo has its own current period; no-response consequences differ.
Work backward from passport expiry, intended arrival, contract start, admission date, certificate expiry, and lawful-status end. Keep a cash and time reserve for renewed records or a further-evidence request. Most importantly, calendar the short post-grant periods for visa collection, entry, activation, and the usual one-month TIE application.
Validity
Protect Work Rights, Renewal Timing, Residence Continuity, and the Path to Long-Term Status
The authorisation controls legal rights while the TIE records them and must remain accurate and usable.
Read the grant resolution for the authorisation start and end dates, territory or occupation limits, work conditions, employer or activity, family position, activation requirement, and any reporting duty. Then check that the TIE accurately reflects the decision. The card is evidence, not the source of every right. A lost, stolen, damaged, or incorrect card needs replacement, but the response must also protect the underlying status and passport evidence.
Calendar the renewal or modification window from the official sheet well before expiry. Collect ongoing evidence during the year: padrón history, complete passport copies, entry and exit records, employment contracts and payslips, Social Security history, tax filings, business accounts, insurance, study progress, household funds, family status, and any integration evidence. Which items matter depends on the route.
A change of employer, occupation, business, studies, address, family relationship, passport, or income can be harmless, reportable, or require modification. Do not infer the answer from the words on the card. Check the authorisation and current rule before acting. Non-lucrative holders must not begin work without a lawful modification. Student and family work rights need their own analysis.
Preserve a dated residence and travel record
Keep every grant, visa, TIE, renewal receipt, passport, padrón certificate, Social Security event, and travel date. Timely renewal filing can protect the existing authorisation while the case is decided under its specific rule, but only if the correct application was actually registered. A screenshot of a draft or authentication session is not enough.
The national long-term residence route permits indefinite residence and work under the same conditions as Spanish nationals. The ordinary branch generally requires five years of lawful continuous qualifying residence. Continuity normally tolerates absences of no more than six consecutive months and no more than ten months total across those five years, or eighteen months total where absences are for work reasons. Other qualifying branches and special counting rules exist, so audit the exact history.
Long-term status is indefinite, but the physical TIE still needs periodic renewal and prolonged absence can affect status under separate rules. EU long-term residence is another route with different mobility implications. Do not choose only by name.
Before travel near an expiry or pending renewal, verify re-entry documents and destination transit rules. Carry the passport, current card or qualifying renewal and return evidence, and copies of the filing receipt and decision. Seek route-specific confirmation instead of relying on an airline agent to interpret Spanish status.
Problems
Fix Wrong-Route Filings, Missing Proof, Activation Failures, Silence, Refusal, and Card Errors
Preserve the file and deadline first, then use the remedy written in the notice for the exact procedure.
A wrong-route case should be diagnosed before adding more documents. Compare nationality, location and status at filing, purpose, applicant, sponsor, form, fee, and responsible authority with the live sheet. A consular-only initial route filed from Spain, an EU-family case filed as ordinary family reunification, or a work plan filed as non-lucrative residence may require withdrawal and a correct new route, not a cosmetic correction. Get case-specific advice before abandoning a lawful pending position.
If the authority sends a correction or further-evidence request, record the valid notification date, deadline, requested items, and consequence of no response. Answer each numbered point with a short explanation and indexed exhibit. Replace expired or incomplete records, authenticate and translate them correctly, and explain discrepancies. Submit through the designated channel and retain the registry receipt. An email attachment or saved portal draft is not proof unless the procedure accepts it and confirms receipt.
Treat silence and post-grant failures precisely
Administrative silence is route-specific. Some procedures treat no decision by the statutory period as refusal, while others can have a different effect. The Spanish-family sheet currently states a two-month period and negative silence. Never start work, travel, or claim status solely because an estimated decision date passed. Obtain the file status and apply the remedy available for that procedure.
A favourable resolution can still fail operationally if the holder misses visa collection, entry, Social Security registration, or TIE steps. Contact the deciding authority immediately with the resolution, dates, reason, and evidence. An employer's failure to complete activation, a changed contract, or an involuntary employment loss may have specific notice or substitution options, but they are not automatic across routes. Do not work outside the permission while improvising a solution.
For refusal, read the facts, legal grounds, remedy, authority, and deadline printed in the valid notice. Preserve the entire filed pack and notification evidence. Decide whether the record can be corrected by a new application, an administrative reconsideration appeal, a higher administrative remedy where available, or judicial review. The best option depends on whether the defect is curable, whether facts changed after filing, and whether the authority made a factual or legal error. Judicial proceedings normally justify qualified Spanish immigration counsel.
For a TIE error, loss, theft, or damage, use the police replacement procedure promptly and preserve the report and appointment evidence. If the card merely reproduces an incorrect grant, challenge or correct the underlying resolution as well. For digital-notification or portal failure, capture timestamps, technical messages, registry attempts, and support tickets, then use an accepted alternative before the deadline where legally available.
